I <br /> I1 Apprentice Utilization Plan, it shall be updated and resubmitted after Substantial <br /> 2 Completion but no later than 30 days after Physical Completion. <br /> 3 <br /> 1 4 If the Contractor fails to submit GFE documentation or if the Engineer does not <br /> 5 approve the GFE, the Contractor will be subject to disciplinary actions as allowed <br /> 6 under WAC 468-16-180. <br /> I 7 <br /> 8 Good Faith Efforts <br /> 9 • The GFE shall describe in detail why the Contractor is not or was not able to attain <br /> I 10 the Apprentice Utilization Requirement. The GFE documentation shall address one <br /> 11 or more of the following areas: <br /> 12 <br /> I 13 1. Correspondence on solicitation of Apprentices from a State-approved <br /> 14 Apprenticeship Training Program(s), and the response from the solicited <br /> 15 State-Approved Apprenticeship Training Program(s) when there is a lack of <br /> I 16 availability of Apprentices. <br /> 17 <br /> 18 2. Provide documentation that shows Contract requirements for TERO, <br /> 19 Special Training or Disadvantage Business Enterprise requirements affect <br /> I20 the ability to obtain Apprentice Labor Hours on the Contract. <br /> 21 <br /> 22 3. Provide documentation demonstrating what efforts the Contractor has <br /> I 23 taken to require Subcontractors to solicit and employ Apprentices. <br /> 24 Documentation could be posters placed on site, emphasis in subcontracts <br /> 25 about employing Apprentices, letters, memos or other correspondence <br /> 26 from Contractor to Subcontractor that put an emphasis on employing <br /> 27 Apprentices. <br /> 28 <br /> I 29 Contractors may receive a GFE credit for graduated Apprentice hours through the <br /> 30 end of the calendar year for all projects worked on as long as the Apprentice remains <br /> 31 continuously employed with the same Contractor they were working for when they <br /> I 32 graduated. If an Apprentice graduates during employment on a project of significant <br /> 33 duration, they may be counted towards a GFE credit for up to one year after their <br /> 34 graduation or until the end of the project (whichever comes first). Determination of <br /> 35 whether or not Contract requirements were met in good faith will be made by <br /> I 36 subtracting the hours from the journeyman total reported hours for the project and <br /> 37 adding them to the apprentice hour total. If the new utilization percentage meets the <br /> 38 Contract requirement, the Contractor will be reported as meeting the requirement in <br /> I 39 good faith. <br /> 40 <br /> 41 Payment <br /> I 42 All costs incurred by the Contractor for complying with this specification shall be <br /> 43 included in the Contract prices for the Bid items of Work involved. <br /> 44 <br /> I 45 07,11,Gi7: <br /> 46 Requirements for Nondiscrimination <br /> 47 <br /> I <br /> 48 a- 7 s s.IN5T1,GR` <br /> 49 Section 1-07.11 is supplemented with the following: <br /> 50 <br /> I <br /> N.
