I 1 coverage shall be excess over and as least as broad in coverage as the Contractor's 2 Commercial General and Auto Liability insurance 3 I 4 All entities listed under 1-07.18(2) of these Special Provisions shall be named as additional 5 insureds on the Contractor's Excess or Umbrella Liability insurance policy. 6 I 7 This requirement may be satisfied instead through the Contractor's primary Commercial 8 General and Automobile Liability coverages, or any combination thereof that achieves the 9 overall required limits of insurance. I 10 11 C051-07,18(5).,K R7t 12 1-07.18(5)J Pollution Liability I 13 (January 4, 2016 APWA GSP) 14 15 The Contractor shall provide a Contractors Pollution Liability policy, providing coverage for I 16 claims involving bodily injury, property damage (including loss of use of tangible property 17 that has not been physically injured), cleanup costs, remediation, disposal or other handling 18 of pollutants, including costs and expenses incurred in the investigation, defense, or 19 settlement of claims, arising out of any one or more of the following: 20 1. Contractor's operations related to this project. 21 2. Remediation, abatement, repair, maintenance or other work with lead-based paint or 22 materials containing asbestos. I 23 3. Transportation of hazardous materials away from any site related to this project. 24 25 All entities listed under 1-07.18(2) of these Special Provisions shall be named by I 26 endorsement as additional insureds on the Contractors Pollution Liability insurance policy. 27 28 Such Pollution Liability policy shall provide the following minimum limits: I 29 *** $2,000,000 *** each loss and annual aggregate 30 31 1-C7,18(5)K.RTF I 32 1-07.18(5)K Professional Liability 33 (January 4, 2016 APWA GSP) 34 35 The Contractor and/or its Subcontractor(s) and/or its design consultant providing I36 construction management, value engineering, or any other design-related non-construction 37 professional services shall provide evidence of Professional Liability insurance covering 38 professional errors and omissions. I 39 40 Such policy shall provide the following minimum limits: 41 $1,000,000 per claim and annual aggregate I 42 43 If the scope of such design-related professional services includes work related to pollution 44 conditions, the Professional Liability insurance shall include coverage for Environmental I 45 Professional Liability. 46 47 If insurance is on a claims made form, its retroactive date, and that of all subsequent I 48 renewals, shall be no later than the effective date of this Contract. 49 N.
