' 4.7 Attention to Work
<br /> ' A. The Contractor, acting through its representative, shall give personal attention to and shall manage the Work
<br /> so that it shall be prosecuted faithfully and completed under the Project schedule. When its representative is
<br /> not personally present at the Project Site, its designated alternate shall be available and shall have the
<br /> authority to act in matters relating to this Contract.
<br /> 4.8 Safety
<br /> ' A. The Contractor alone shall be responsible for safety on the job Site, including, but not limited to, the safety
<br /> of its and its Subcontractor's employees. The Contractor shall maintain the Project Site and perform the
<br /> Work in a manner which meets the Owner's responsibility under statutory and common law for the
<br /> provision of a safe place to work.
<br /> 4.9 Threats, Intimidation and Harassment Forbidden
<br /> ' A, Contractor shall not allow its employees, its Subcontractors, its Subcontractors' employees, or any other
<br /> agents to threaten bodily injury or property damage, to intimidate or attempt to intimidate any person, or to
<br /> assault or physically harass any person. Forbidden conduct includes, but is not limited to, threatening,
<br /> appearing, or actually doing any of the following: pushing, shoving, striking, physically blocking a person
<br /> or a person's vehicle, vandalism, malicious mischief, or any other act that a reasonable person would
<br /> understand be intended to intimidate, cause personal injury, or cause property damage. Contractor shall
<br /> remove from the job site any person reasonably under its control or direction who the Contractor or Owner
<br /> reasonably believes violated this section. The lack of a request from the Owner or Owner's Representative
<br /> to the Contractor to remove someone from the job Site does not relieve the Contractor from its obligation to
<br /> remove someone.
<br /> 4.10 Weapons Forbidden
<br /> A. Contractor shall not allow its employees, its Subcontractors, its Subcontractors' employees, or any other
<br /> agents or representatives to carry or possess, openly or concealed, explosives or weapons on the job Site,
<br /> except: (a) such explosives are as reasonably required for performance of the Work, such as those
<br /> ' necessary for blasting or demolition work called for by the Contract Documents or(b) commissioned law
<br /> enforcement officers or security personnel under authority of their commission. A weapon is any object,
<br /> instrument or chemical which is (1) designed in such a manner to inflict harm or injury to another person;
<br /> ' or(2)any item used in a manner threatening harm or injury to another person. Weapons include,but are not
<br /> limited to, firearms, dangerous knives, dangerous chemicals, tear gas, martial arts weapons, blackjacks or
<br /> other weapons. Further, weapons should include those delineated in EMC Chapter 10.78. b. Possession of
<br /> mace, pepper spray or the like for defensive purposes is not a violation of this policy. Contractor shall
<br /> ' remove from the job Site any person reasonably under its control or direction who the Contractor or Owner
<br /> reasonably believes violated this section. The lack of a request from the Owner or Owner's Representative
<br /> to the Contractor to remove someone from the job Site does not relieve the Contractor from its obligation to
<br /> remove someone.
<br /> 4.11 Safety Standards
<br /> ' A. The Contractor shall comply with Section 107 of the Contract Work Hours and Safety Standards Act (40
<br /> U.S.C. 327-330) as supplemented by Department of Labor Regulations (29 CFR, Part 5). Under this
<br /> section,the Contractor shall not require any laborer or mechanic to work in surroundings or under working
<br /> conditions that are unsanitary, hazardous, or dangerous to its health and safety as determined under
<br /> construction, safety, and health standards promulgated by the Secretary of Labor. These requirements do
<br /> not apply to the purchase of supplies or materials or articles ordinarily available on the open market, or
<br /> ' contracts for transportation or transmission of intelligence.
