WHEREAS, EMC 19.41.170(C) provides for amendment of the Zoning Code (Title 19) when it finds that: <br /> 1)the proposed amendment is consistent with the applicable provisions of the Everett general plan; and <br /> 2)the proposed amendment bears a substantial relation to public health, safety or welfare; and 3) the <br /> proposed amendment promotes the best long term interests of the Everett community; and <br /> WHEREAS, the proposed Chapter 19, Metro Everett Uses (Exhibit 1), establishes a list of uses and use <br /> development standards in Metro Everett that the Planning Commission determines, after receiving <br /> public input, that is what the community desires, consistent with the Metro Everett Subarea Plan, and <br /> promotes the best long term interests of the Everett community; and <br /> WHEREAS, the proposed Chapter 20, Metro Everett and Core Residential Area Development Standards <br /> (Exhibit 2), establishes development standards for Metro Everett and the Core Residential Area Overlay, <br /> which implement the Land Use, Urban Design and other parts of the Metro Everett Subarea Plan and <br /> City Comprehensive Plan (aka Everett general plan); and <br /> WHEREAS, the proposed development regulations bears a substantial relation to public health, safety or <br /> welfare. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Ordinance No. 1671-89, as amended (EMC Title 19), is amended by the addition of the <br /> following chapter: Metro Everett Uses, as set forth in Exhibit 1 attached hereto, to be codified as EMC <br /> Chapter 19.19. <br /> Section 2. Ordinance No. 1671-89, as amended (EMC Title 19), is amended by the addition of the <br /> following chapter: Metro Everett and Core Residential Area Development Standards, as set forth in <br /> Exhibit 2 attached hereto, to be codified as EMC Chapter 19.20. <br /> Section 3. Maps 19-1 (Metro Everett Zoning Map), 19-2 (Street Type Designations), and 19-3 (Permitted <br /> Drive-Through Areas in Metro Everett) that are within Exhibit 1 attached hereto, and Maps 20-1 (Metro <br /> Everett Zoning Map), 20-2 (Metro Everett Street Designations), 20-3 (Core Residential Area), 20-4(23rd& <br /> 24th Street Setback Required), 20-5 (Maximum Building Heights in Metro Everett), and 20-6 (Height <br /> Limits in Core Residential Area) that are within Exhibit 2 attached hereto, supersede any zoning, street <br /> or height map included in any prior ordinance affecting the areas shown in the aforementioned maps. <br /> Section 4. Severability. Should any section, paragraph, clause or phrase of this Ordinance, or its <br /> application to any person or circumstance, be declared unconstitutional or otherwise invalid for any <br /> reason, or should any portion of this Ordinance be pre-empted by state or federal law or regulations, <br /> this shall not affect the validity of the remaining portions of this Ordinance or its application to other <br /> persons or circumstances. <br /> Section 5. Conflict. In the event there is a conflict between the provisions of this Ordinance and <br /> any other City ordinance, the provisions of this Ordinance shall control. <br /> Chapters 19&20,Metro Everett and Core Residential Area Development <br /> Regulations 3 8/29/18 <br />
