<br /> THIS DEDICATION OF INGRESS/EGRESS & UTILITY EASEMENT ("EASEMENT
<br /> DEDICATION") is made the day and year of the recordation of this instrument by BENSON &
<br /> WOLKEN PROPERTIES, LLC, a Washington limited liability company ("BENSON &
<br /> WOLKEN").
<br /> BENSON & WOLKEN is the record owner and vested in fee simple title of the following
<br /> described real estate located in Snohomish County, Washington (the "PARCEL A"):
<br /> THE LEGAL DESCRIPTION OF PARCEL A IS ATTACHED HERETO
<br /> AND INCORPORATED HEREIN BY THIS REFERENCE ON
<br /> EXHIBIT"A."
<br /> For and in consideration of the sum of ten dollars ($10.00) in hand paid by the Port of
<br /> Everett, a port district organized under the laws of the State of Washington, the receipt of which
<br /> is hereby acknowledged, and other good and valuable consideration, including the benefits that
<br /> will accrue to PARCEL A, BENSON & WOLKEN ("GRANTOR"), as the owner of above
<br /> PARCEL A in City of Everett, Snohomish County, State of Washington, does hereby dedicate,
<br /> declare, grant, and make this Easement over, above, on and under a portion of PARCEL A, as
<br /> legally described below ("EASEMENT ROW" or "EASEMENT AREA"), to the CITY OF
<br /> EVERETT, for the use and benefit of the public as a perpetual right-of-way and easement for the
<br /> passage and accommodation of vehicular and pedestrian traffic, and the construction, operation,
<br /> use, maintenance, inspection, repair, alteration, and replacement of a paved road within the
<br /> boundaries of the EASEMENT ROW, and for all other purposes for which a public street and
<br /> right-of-way is commonly used, including, installing, repairing, maintaining, altering, replacing,
<br /> relocating and operating utilities in, into, upon, over, across, and under said EASEMENT ROW,
<br /> including, but not limited to, all such uses permitted by the laws of the State of Washington and
<br /> the Ordinances of the City of Everett, Washington.
