1 <br /> I1 <br /> 2 <br /> ' 3 <br /> 4 1-07 LEGAL RELATIONS AND RESPONSIBILITIES TO THE PUBLIC <br /> 5 <br /> I 6 1-07.1 Laws to be Observed <br /> 7 (October 1, 2005 APWA GSP) <br /> 8 <br /> I9 Supplement this section with the following: <br /> 10 <br /> 11 In cases of conflict between different safety regulations, the more stringent regulation shall <br /> 12 apply. <br /> 13 <br /> 14 The Washington State Department of Labor and Industries shall be the sole and paramount <br /> 15 administrative agency responsible for the administration of the provisions of the Washington <br /> I16 Industrial Safety and Health Act of 1973 (WISHA). <br /> 17 <br /> 18 The Contractor shall maintain at the project site office, or other well known place at the <br /> I19 project site, all articles necessary for providing first aid to the injured. The Contractor shall <br /> 20 establish, publish, and make known to all employees, procedures for ensuring immediate <br /> 21 removal to a hospital, or doctor's care, persons, including employees, who may have been <br /> I22 injured on the project site. Employees should not be permitted to work on the project site <br /> 23 before the Contractor has established and made known procedures for removal of injured <br /> 24 persons to a hospital or a doctor's care. <br /> 25 <br /> 26 The Contractor shall have sole responsibility for the safety, efficiency, and adequacy of the <br /> 27 Contractor's plant, appliances, and methods, and for any damage or injury resulting from <br /> 28 their failure, or improper maintenance, use, or operation. The Contractor shall be solely and <br /> I29 completely responsible for the conditions of the project site, including safety for all persons <br /> 30 and property in the performance of the work. This requirement shall apply continuously, and <br /> 31 not be limited to normal working hours. The required or implied duty of the Engineer to <br /> I32 conduct construction review of the Contractor's performance does not, and shall not, be <br /> 33 intended to include review and adequacy of the Contractor's safety measures in, on, or near <br /> 34 the project site. <br /> 35 <br /> 36 (April 3, 2006, WSDOT GSP) <br /> 37 Confined Space <br /> I38 <br /> 39 Confined spaces are known to exist at the following locations: <br /> 40 <br /> I41 *** Existing and Proposed Catch Basins and Manholes, Proposed Comm Vaults *** <br /> 42 <br /> 43 The Contractor shall be fully responsible for the safety and health of all on-site workers and <br /> I44 compliant with Washington Administrative Code (WAC 296-809). <br /> 45 <br /> 46 The Contractor shall prepare and implement a confined space program for each of the <br /> 47 confined spaces identified above. The Contractors Confined Space program shall be sent to <br /> I48 the Contracting Agency at least 30 days prior to the Contractor beginning work in or adjacent <br /> 49 to the confined space. No work shall be performed in or adjacent to the confined space until <br /> 50 the plan is submitted to the Engineer as required.
