I <br /> 1 Prompt Payment I <br /> 2 Prompt payment to all subcontractors shall be in accordance with Section 1-08.1. <br /> 3 Prompt payment requirements apply to progress payments as well as return of <br /> 4 retainage. <br /> 5 <br /> 6 Required SBE Reporting <br /> 7 The Contractor and all subcontractors/suppliers/service providers that utilize DBEs to <br /> 8 perform work on the project, shall maintain appropriate records that will enable the <br /> 9 Engineer to verify DBE participation throughout the life of the project. <br /> 10 <br /> 11 Refer to Section 1-08.1 for additional reporting requirements associated with this <br /> 12 contract. <br /> 13 <br /> 14 Definitions <br /> 15 Regardless of race or gender, a SBE is one certified by OMWBE as such, where the <br /> 16 firm's: <br /> 17 <br /> 18 (a) Three year averaged gross receipts are less than $22.41 million dollars, with <br /> 19 smaller industry standards applicable <br /> 111 <br /> 20 <br /> 21 (b) Is at least 51% owned and controlled by an individual or individuals with a personal <br /> 22 net worth less than $1.32 million dollars <br /> 23 <br /> 24 (c) A Micro Small Business Enterprise is a firm certified as an SBE with average gross <br /> 25 receipts for three years less than one million dollars <br /> 26 <br /> 27 <br /> 28 <br /> 29 1-07.12 Federal Agency inspection <br /> 30 <br /> 31 Section 1-07.12 is supplemented with the following: <br /> 32 <br /> 33 <br /> 34 (January 25, 2016, WSDOT GSP OPT1) <br /> 35 <br /> 36 Required Federal Aid Provisions <br /> 37 The Required Contract Provisions Federal Aid Construction Contracts (FHWA 1273) Revised <br /> 38 May 1, 2012 and the amendments thereto supersede any conflicting provisions of the I <br /> 39 Standard Specifications and are made a part of this Contract; provided, however, that if any <br /> 40 of the provisions of FHWA 1273, as amended, are less restrictive than Washington State <br /> 41 Law, then the Washington State Law shall prevail. <br /> 42 <br /> 43 The provisions of FHWA 1273, as amended, included in this Contract require that the <br /> 44 Contractor insert the FHWA 1273 and amendments thereto in each Subcontract, together <br /> 45 with the wage rates which are part of the FHWA 1273, as amended. Also, a clause shall be 111 <br /> 46 included in each Subcontract requiring the Subcontractors to insert the FHWA 1273 and <br /> 47 amendments thereto in any lower tier Subcontracts, together with the wage rates. The <br /> 48 Contractor shall also ensure that this section, REQUIRED FEDERAL AID PROVISIONS, is <br /> 49 inserted in each Subcontract for Subcontractors and lower tier Subcontractors.
