I 1 1 A Criterion: The Bidder shall not owe delinquent taxes to the Washington State 2 Department of Revenue without a payment plan approved by the Department of I3 Revenue. 4 5 B. Documentation: The Bidder, if and when required as detailed below, shall sign a 6 statement (on a form to be provided by the Contracting Agency) that the Bidder I 7 does not owe delinquent taxes to the Washington State Department of Revenue, 8 or if delinquent taxes are owed to the Washington State Department of Revenue, 9 the Bidder must submit a written payment plan approved by the Department of I10 Revenue, to the Contracting Agency by the deadline listed below. 11 12 2. Federal Debarment 1 13 14 A Criterion: The Bidder shall not currently be debarred or suspended by the 15 Federal government. I16 17 B. Documentation: The Bidder shall not be listed as having an "active exclusion" on 18 the U.S. government's "System for Award Management" database 111 19 (www.sam.gov). III 20 21 3. Subcontractor Responsibility I22 23 A Criterion: The Bidder's standard subcontract form shall include the subcontractor 24 responsibility language required by RCW 39.06.020, and the Bidder shall have 25 an established procedure which it utilizes to validate the responsibility of each of ' 26 its subcontractors. The Bidder's subcontract form shall also include a 27 requirement that each of its subcontractors shall have and document a similar 28 procedure to determine whether the sub-tier subcontractors with whom it I29 contracts are also "responsible" subcontractors as defined by RCW 39.06.020. 30 31 B. Documentation: The Bidder, if and when required as detailed below, shall submit I32 a copy of its standard subcontract form for review by the Contracting Agency, and 33 a written description of its procedure for validating the responsibility of 34 subcontractors with which it contracts. 35 36 4. Claims Against Retainage and Bonds 37 I 38 A Criterion: The Bidder shall not have a record of excessive claims filed against the 39 retainage or payment bonds for public works projects in the three years prior to 40 the bid submittal date, that demonstrate a lack of effective management by the I41 Bidder of making timely and appropriate payments to its subcontractors, 42 suppliers, and workers, unless there are extenuating circumstances and such 43 circumstances are deemed acceptable to the Contracting Agency. 44 45 B.
