• A JOC System License Fee of one and ninety-five hundredths percent <br /> (1.95%)of the value of work ordered through the JOC program; <br /> • A Job Order Development Fee of three and five hundredths percent <br /> (3.05%)of the value of work ordered through the JOC program; and <br /> • A Construction Management Fee of five and ninety-five hundredths <br /> percent(5.95%)of the value of work ordered through the JOC program. <br /> • The JOC System License Fee and Job Order Development Fee shall be <br /> payable by the City when the Notice to Proceed has been issued on a <br /> Job Order assigned to the JOC contractor. The Construction <br /> Management Fee shall be payable when construction of a Job Order has <br /> been completed and accepted by the City, except at the election of <br /> Service Provider, Job Orders requiring more than sixty (60) days to <br /> complete shall be payable monthly on a percentage of completion. <br /> b. The City has elected to utilize the JOC Complete Solution service option and, unless <br /> otherwise directed by the City, Service Provider shall perform the services set forth in <br /> Exhibit A, Paragraph 1.3(B), and the City agrees to pay the fees provided in Paragraph <br /> 1(a)(ii)of this Exhibit B. <br /> The JOC System License fee is subject to Washington State sales tax at the current City <br /> of Everett tax rate. The Job Order Development fee is exempt from sales tax as a <br /> professional service. <br /> In the event the City elects to utilize an alternative JOC solution option, the City shall <br /> provide reasonable notice of its selected service option,and agrees to pay the applicable <br /> fees pursuant to the terms and conditions of Exhibit B. <br /> c. In consideration for Construction Cost Estimating Services and when such services are <br /> requested by the City, the City shall pay Consultant a fee of$130 per hour. This rate <br /> will remain in effect for the life of this contract, and may be adjusted annually on the <br /> contract execution date of each subsequent year by CPI,as published by the US Bureau <br /> of Labor Statistics, for a twelve (12)month period or 3%,whichever is less. <br /> 2. Contractor License Fee <br /> a. The City acknowledges that each JOC contractor shall be assessed a Contractor License <br /> Fee equal to one percent (1.00%) of the value of each Job Order issued to them for <br /> access to Service Provider's JOC information management application and <br /> construction cost data. <br /> b. The City acknowledges that Service Provider will require JOC contractors awarded a <br /> contract by the City to agree to a JOC System License similar in form to the JOC <br /> System License provided in Exhibit A,Paragraph 1.5,and to make timely payments to <br /> Gordian Group,Inc.Professional Services Agreement(2018) <br />
