12. Appeals toZoning hearingcodetext examiner. <br /> A. The city's land use hearing examiner is hereby provided jurisdiction to hear appeals of the decisions <br /> of the planning director under this ordinance. Said appeals shall be as follows: <br /> 1. Appeal of a decision of the planning director that the owner is not entitled to a final certificate <br /> of tax exemption,filed within thirty days of notification by the city to the owner of denial of a <br /> final certificate of tax exemption. <br /> 2. Appeal of a cancellation of tax exemption,filed within thirty days of the notification by the city <br /> to the owner of cancellation. <br /> B. The hearing examiner's procedures shall apply to hearings under this ordinance to the extent they <br /> are consistent with the requirement of this ordinance and Chapter 84.14. RCW.The hearing <br /> examiner shall give substantial weight to the planning director's decision and the burden of <br /> overcoming the weight shall be on the appellant. The decision of the examiner constitutes the final <br /> decision of the city. An aggrieved party may appeal the decision to superior court under RCW <br /> 34.05.510 through 34.05.598 if the appeal is properly field within thirty days of notification by the <br /> city to the appellant of that decision. <br /> Section 3. Ordinance 3390-14 (Fee Schedule for Land Use Applications, Permits, Review Processes, and <br /> Related Services, EMC 16.72.010.D) is amended to read as follows: <br /> 16.72.010 Establishment of fees—Fee schedule. <br /> The following schedule of fees shall apply for the processing of land use applications, permits, review <br /> processes and related services for the department of planning and community development: <br /> D.Type of Action or Application Fee <br /> 1. Special studies required for any land use process $400 <br /> 2. Subdivisions, short subdivisions, binding site plans: <br /> Preliminary approval $5,000 plus$100 per lot <br /> Final plat approval $1,000 plus$50 per lot <br /> Variance, alteration or vacation $1,000 <br /> Variance, administrative $500 <br /> 3.Time extension for all land use permits $250 <br /> 4. Unlisted use determination $500 <br /> 5. Unspecified land use permits not listed herein To be determined by director <br /> 6. Variance: <br /> Single-family residential zone or use $750 <br /> All other variances $1,500 <br /> 76. Zoning certification letter <br /> amendment: $100 <br /> Letter requesting initiation $500 <br /> Fee if commission or council agree to consider $5,000 <br /> 9. Multifamily Tax Exemption Application, City Processing $1,000 base fee, plus$50 per <br /> Fee residential unit <br /> 10. Multifamily Tax Exemption Application, County $150 <br /> Assessor Processing Fee <br /> 11.
