C <br /> ORDINANCE NO. 1-71/6?- /R9 <br /> AN ORDINANCE PROVIDING FOR THE VACATION OF <br /> A PORTION OF 12TH STREET FROM THE ALLEY <br /> WEST OF CHESTNUT STREET EAST TO CHESTNUT STREET. <br /> WHEREAS, by Resolution No. 1194 of the City of Everett, the <br /> City Council has declared its intention to vacate said right-of-way; <br /> and <br /> WHEREAS, the City Council of the City of Everett did by <br /> resolution duly adopt, fixed the 8th day of September 1976, at 10:00 <br /> a.m. of said day for the hearing and determination of said resolution; <br /> and <br /> WHEREAS, due and legal notice of the time and place of said <br /> hearing and determination of said resolution has been given out in the <br /> manner prescribed; and <br /> WHEREAS, at the time and place fixed for hearing favorable <br /> statements and objections to the vacating of the herein described <br /> right-of-way were heard and discussed; and <br /> WHEREAS, it now appears to the City Council of the City of Everett, <br /> that the portion of said right-of-way resolved to be vacated should be <br /> vacated; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That portion of 12th Street from the alley west of Chestnut <br /> St. east to Chestnut Street abutting upon Lot 11, Block 228 <br /> and Lot 20, Block 229, Plat of Everett, Division "0" according <br /> to the plat thereof recorded in Volume 6 of Plats, page 9, <br /> records of Snohomish County, Washington be and the same is <br /> hereby vacated: <br /> Section 2: <br /> The City of Everett, its successors or assigns shall not <br /> be responsible or liable for storm drainage runoff <br /> resulting from existing drainage patterns as established on City <br /> rights-of-way that may now or in the future go over, under <br /> or across the above described street vacation. <br /> Section 3: <br /> That the Ordinance shall not become effective until the <br /> owners of property abutting upon the streets hereinafter <br />
