g. Soliciting sales by phone from a location outside the city. <br /> 5. A seller located outside the city merely delivering goods into the city by means of common <br /> carrier is not required to register and obtain a business license; provided, that it engages in no <br /> other business activities in the city. Such activities do not include those in subsection 4 of this <br /> definition. <br /> The city expressly intends that engaging in business include any activity sufficient to establish <br /> nexus for purposes of applying the license fee and tax under the law and the Constitutions of <br /> the United States and the state of Washington. Nexus is presumed to continue as long as the <br /> taxpayer benefits from the activity that constituted the original nexus generating contact or <br /> subsequent contacts. <br /> Section 2. Effective Date. <br /> This Ordinance shall take effect on December 31, 2018. <br /> Section 3. Referendum Provisions. <br /> To the extent RCW 35.21.706 is applicable, the residents of the City of Everett are put on notice that this <br /> Ordinance is subject to Article XI of the Charter of the City of Everett. Article XI entitles direct legislation <br /> and provides procedures which must be followed for exercising the power of initiative or referendum <br /> and shall be the special initiative procedure adopted in this chapter pursuant to RCW 35.21.706. <br /> Section 4. General Duty. <br /> It is expressly the purpose of this Ordinance to provide for and promote the health, safety, and welfare <br /> of the general public and not to create or otherwise establish or designate any particular class or group <br /> of persons who will or should be especially protected or benefited by the terms of this Ordinance. It is <br /> the specific intent of this Ordinance that no provision or any term used in this Ordinance is intended to <br /> impose any duty whatsoever upon the City or any of its officers or employees. Nothing contained in this <br /> Ordinance is intended nor shall be construed to create or form the basis of any liability on the part of <br /> the City, or its officers, employees, or agents, for any injury or damage resulting from any action or <br /> inaction on the part of the City related in any manner to the enforcement of this Ordinance by its <br /> officers, employees, or agents. <br /> Section 5. Severability. <br /> Should any section, subsection, paragraph, sentence, clause, phrase, or portion of this Ordinance or its <br /> application to any person or situation, be declared unconstitutional or invalid for any reason, such <br /> decision shall not affect the validity of the remaining portions of this Ordinance or its application to any <br /> other person or situation. The City Council hereby declares that it would have adopted this Ordinance <br /> and each section, subsection, paragraph, sentence, clause, phrase, or portion thereof irrespective of the <br />
