CITY <br /> LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT (the "License"), between the City of Everett as Grantor (the "City") and <br /> DEBRA L HUNTER, Personal Representative of the Estate of Alton Franchot Pawling, King County Superior <br /> Court Cause No. 14-4-05564-9 SEA, as the Grantee ("Grantee"), for use of City owned property. <br /> RECITALS <br /> A. Grantee desires to utilize property owned by the City for landscaping, fencing, and yard <br /> area purposes. <br /> B. The City is willing to grant Grantee authority to use City property for certain terms and <br /> conditions. <br /> AGREEMENT <br /> In consideration of mutual benefit to the city and other good and valuable consideration,the receipt and <br /> sufficiency of which is hereby expressly acknowledged, the City licenses Grantee to use the Property upon the <br /> following terms and conditions: <br /> Section 1. LICENSED PROPERTY. A Portion of: <br /> A strip of land in the east half of the northwest quarter and in the northwest quarter of Section 10, <br /> Township 28 North, Range 6 East W.M., described as follows: <br /> First:A strip 100 feet wide between parallel lines drawn 50 feet each side of the following described center <br /> line, to-wit: beginning at a point on the north and south center line of said Section 10, which said point is <br /> 2009.8 feet southerly on said line from the north quarter corner of said section; thence north 39° west <br /> 2766.8 feet to the northerly line of said section 10. <br /> Second:A strip 100 feet wide along the northerly line of the said northwest quarter of the northwest quarter <br /> of said Section 10 described as follows: beginning at the northwest corner of said Section,thence southerly <br /> along the west line of said Section 100 feet; thence easterly parallel to the north line of said Section 10 <br /> and 100 feet distant therefrom to the westerly line of the strip first hereinabove described; thence north <br /> 39° west along said westerly line to the northerly line of said section; thence west along said northerly <br /> line to the northwest corner of said Section 10. <br /> LESS The North 70.0 feet of the West 170 feet of the Northeast Quarter of the Northwest Quarter of the <br /> Northwest Quarter of Section 10 Township 28 North, Range 6, E.W.M. deeded to Ted Wolk by Quit <br /> Claim Deed recorded under Auditor's file No. 7810270285. <br /> The area of use is approximately 5,200 Square Feet as generally depicted on Exhibit"A" attached hereto and <br /> included herein by reference. <br /> Section 2. TERM. This License shall be effective upon execution by the City and shall continue on a <br /> month-to-month basis thereafter subject to a 30-day termination notice period per Section 6 below. <br /> Section 3. AUTHORIZED USE. Grantee may only use the Property for landscaping, fencing, and yard <br /> area purposes. <br /> page 1 <br />
