CITY LICENSE TO USE CITY PROPERTY THIS LICENSE AGREEMENT (the "License"), between the City of Everett as Grantor (the "City") and DEBRA L HUNTER, Personal Representative of the Estate of Alton Franchot Pawling, King County Superior Court Cause No. 14-4-05564-9 SEA, as the Grantee ("Grantee"), for use of City owned property. RECITALS A. Grantee desires to utilize property owned by the City for landscaping, fencing, and yard area purposes. B. The City is willing to grant Grantee authority to use City property for certain terms and conditions. AGREEMENT In consideration of mutual benefit to the city and other good and valuable consideration,the receipt and sufficiency of which is hereby expressly acknowledged, the City licenses Grantee to use the Property upon the following terms and conditions: Section 1. LICENSED PROPERTY. A Portion of: A strip of land in the east half of the northwest quarter and in the northwest quarter of Section 10, Township 28 North, Range 6 East W.M., described as follows: First:A strip 100 feet wide between parallel lines drawn 50 feet each side of the following described center line, to-wit: beginning at a point on the north and south center line of said Section 10, which said point is 2009.8 feet southerly on said line from the north quarter corner of said section; thence north 39° west 2766.8 feet to the northerly line of said section 10. Second:A strip 100 feet wide along the northerly line of the said northwest quarter of the northwest quarter of said Section 10 described as follows: beginning at the northwest corner of said Section,thence southerly along the west line of said Section 100 feet; thence easterly parallel to the north line of said Section 10 and 100 feet distant therefrom to the westerly line of the strip first hereinabove described; thence north 39° west along said westerly line to the northerly line of said section; thence west along said northerly line to the northwest corner of said Section 10. LESS The North 70.0 feet of the West 170 feet of the Northeast Quarter of the Northwest Quarter of the Northwest Quarter of Section 10 Township 28 North, Range 6, E.W.M. deeded to Ted Wolk by Quit Claim Deed recorded under Auditor's file No. 7810270285. The area of use is approximately 5,200 Square Feet as generally depicted on Exhibit"A" attached hereto and included herein by reference. Section 2. TERM. This License shall be effective upon execution by the City and shall continue on a month-to-month basis thereafter subject to a 30-day termination notice period per Section 6 below. Section 3. AUTHORIZED USE. Grantee may only use the Property for landscaping, fencing, and yard area purposes. page 1
