PRODUCTS AND SUBSTITUTIONS <br /> 016300 - 1 <br /> SECTION 016300 -PRODUCTS AND SUBSTITUTIONS <br /> 1. GENERAL <br /> 1.1. Related Documents: Drawings and general provisions of Contract, including General <br /> Conditions and other Division-1 Specification sections, apply to work of this section. <br /> 1.2. Prior Approvals:No alternate products or substitutions will be approved for <br /> inclusion in this project prior to Award of Contract. <br /> 2. DESCRIPTION OF REQUIREMENTS <br /> 2.1. Definitions: Definitions used in this paragraph are not intended to negate the <br /> meaning of other terms used in the contract documents, including such terms as <br /> "specialties", "systems", "structure", "finished", "accessories", "furnishings", "special <br /> construction" and similar terms. Such terms are self-explanatory and have <br /> recognized meanings in the construction industry. <br /> 1. "Products" are items purchased for incorporation in the Work, regardless of <br /> whether they were specifically purchased for the project or taken from the <br /> Contractor's previously purchased stock. The term "product" as used herein <br /> includes the terms "material", "equipment", "system" and other terms of <br /> similar intent. <br /> 1. "Named Products" are products identified by use of the manufacturer's <br /> name for a product, including such items as a make or model <br /> designation, as recorded in published product literature, of the latest <br /> issue as of the date of the contract documents. <br /> 2. "Materials" are products that must be substantially cut, shaped,worked, <br /> mixed, finished, refined or otherwise fabricated,processed, or installed to <br /> form units of work. <br /> 3. "Equipment"is defined as a product with operational parts,regardless of <br /> whether motorized or manually operated, and in particular, a product that <br /> requires service connections such as wiring or piping. <br /> 2.2. Substitutions: The Contractor's requests for changes in the products, materials, <br /> equipment and methods of construction required by the contract documents are <br /> considered requests for"substitutions", and are subject to the requirements specified <br /> herein. The following are not considered as substitutions: <br /> 1. Revisions to the Contract Documents, where requested by the Owner, <br /> Architect or Engineer are considered as "changes"not substitutions. <br /> 2. Specified Contractor options on products and construction methods included <br /> in the Contract Documents are choices available to the Contractor and are not <br /> subject to the requirements for substitutions as herein specified. <br /> 3. Except as otherwise provided in the Contract Documents, the Contractor's <br /> determination of and compliance with governing regulations and orders as <br /> issued by governing authorities do not constitute "substitutions" and do not <br /> constitute a basis for change orders. <br /> 02/19/13 <br />
