Unit#F110 <br /> Everctt, Wash. 98203 <br /> Subj: Order tu Repair Lake Outlet Weir <br /> Dear Ms. Strong <br /> As you have acknowledged in our recent telephone conversations, last summer a representative <br /> of the Village by the Lake Homeowners Association grouted the concrete weir that is the nortnal <br /> outt7ow for Beverly Lake. The only surface oudet for the leke now is the catch basin grate that is <br /> several inches above the concrete weir. As a result, the level of Beverly Lake is now significantly <br /> higher than normal and five compluints have been received by the Mayor's office from lakefront <br /> property owners that have been adversely afTected by the higher than normal lake level. <br /> Chapter 14.28 F,MC authorizes the Ciry to require property owners to correct drainage system <br /> deficiencies. Grouting of the outlet of Beverly Lake lazt summer by a representative of the <br /> Village by the Lake Homeowner's Association constitutes a drainage system deficiency that <br /> must be immediately cortected by the Village by the Lake Homeowners Association. <br /> To correct the lake outlet deficiency, the grouted weir must be retumed to its original condition. <br /> To accompl�sh this, the Village by the Lalce Homeowners Association may need to acquire a <br /> Hydraulic Project Approval (HPA) &om the Wash. St. Dept.of Fish and Wildlife. Permits from <br /> other state agencies, such as a temporary water quality modification from the Wash. St. Dept. of <br /> Ecology may also be required. <br /> The Village by the Lake Homeowners Association is hercby directed to restore the concrete <br /> outlet to its condition prior to the grouting. This needs to occur immediately.
