CITY <br /> MOTORCYCLE TRANSFER AGREEMENT <br /> (EDUCATIONAL PURPOSES) <br /> This Agreement is dated for reference purposes 113/2: 11.3 and is between the CITY OF <br /> EVERETT (the "City") and the IMAGINE CHILDREN'S MUSEUM (the "Museum"). <br /> BACKGROUND <br /> A. By City Council resolution 13Qb , and in accordance with Chapter 3.88 of the <br /> Everett Municipal Code, the City Council determined that the following motorcycle is surplus <br /> (the "Motorcycle"): <br /> Year: 2009 <br /> Make: Honda <br /> Model: ST1300PA <br /> VIN: JH2SC51749K600098 <br /> B. The trade-in value of the Motorcycle would be about $5000. This estimate was <br /> determined by the City's Purchasing Manager based on market comparisons However, the <br /> Motorcycle is not currently functional and requires at least$2500 of repairs. In light of its <br /> condition, the estimated fair market value of the Motorcycle is less than $2500 and might be <br /> considerably less than $2500. <br /> C. In accordance with Chapter 3.88 of the Everett Municipal Code, the City Council <br /> has determined to transfer the Motorcycle to the Museum for use as an educational exhibit. <br /> D. The purpose of the transfer is for the Motorcycle to be used for educational <br /> purposes that will further the general welfare of the citizens of the City. Motorcycle safety <br /> (such as always wearing a helmet) is an important aspect of traffic safety. <br /> AGREEMENT <br /> The City and the Museum agree as follows: <br /> 1. The Museum understands that the Motorcycle will be delivered in a disabled <br /> condition. To the extent required by applicable law, the Museum understands that the <br /> Motorcycle may be provided to the Museum with police markings and lights removed. <br /> 2. In exchange for the Motorcycle, the Museum as appropriate will integrate <br /> learning about motorcycle safety into its educational programs from time to time. Upon <br /> 1 <br />
