b. Conclusion: 9ased on the fact that thr_ use is slready estab]ished the
City Staff`s evaluation of the evidence Chat the level of
parking nee3ed for t;he use is substantfally less than
that required by [he Zoning Code, it does not appear
that the granting of this variance would be detriner.tal
to the public elfare or injurious to oehers in the
vicinity or zone.
Criterion 44:
That the grau[ing of such variance Nill not adversely aifect the
Comprehensive General Plan.
a. Pinding: The Comprehensive Ceneral Plan designates the subject
property "Clin.ics, 1edical, and Professional Offices, and
Multfple Family." The General Plan Policiea contain a
Section on Fublic Pacilities - Institutional, which
states "Decause the types of services and level of
actvity may vary from clinic to clinic and the parking
needs of a clinic, in certain circumstances, may be less
than the requireaents of the Zoning Code, leas parking
[han required by the 2oning Code may be provided if 7[
can be demonstrated throagh sufflcient documentatfon and
parkin3 studies, that the use of the building will
generate lesa traffic, provided such an aduatmen[ is
approved 6y the Doard of Adjustment or Land Use Hearing
Examiner."
b. Conclusion: The use of the subect property is conaistent with [he
Comprehensive Ceneral Plan. The adopted policies of the
plan include a provision for reduced parking
requirements, in certain cases, for highly epecialized
linics. The docunentation aubmitted by the applicant
demonstrates [hat this facility generates less traffic
and its parking need is less than that required by Code.
The granting f thia variance will not adversely affect
the Comprehensive Plan.
NOW, THEREFCRE, the Board of Adustment of the City of Everett does
hereby order tha[ the variance Ue GRANTED to allow 1,251 square foot
expansion of the clinic while ptoviding 63 off-etreet parking spaces instead
of the 68 spaces requied by Code, and further require the applicant to meet
the follawing conditions:
1. Any change of uce of the site or increase in the number of doctora at
the clinic shall require further review by the Planning Department.
2. At the time when the u¢occupied office (Dr. Salama's) is rented, the
City of Everett Planning Department shall be notified. The Planning
Department will review the parking requirements oY the nea practice
to determine if the parking requirements are conaiatent wfth the
other highly specialized practices at 4310 Colby. If the review
indicatea that there is a shortfall in terms of parking for the
clinic, then the aatter ahall ba returned to the Board of Adjustment
for consideration.
-4-
