AMENDMENT NO. 4 CITY <br /> PROFESSIONAL SERVICES AGREEMENT <br /> (PUBLIC DEFENSE OVERSIGHT) <br /> This Amendment No. 4 is dated for reference purposes January 1, 2019. It is by <br /> and between the City of Everett, a municipal corporation under the laws of the State of <br /> Washington("City") and Mark D. Mestel, Inc. P.S. ("Attorney Service Provider"). <br /> RECITALS <br /> A. The City and Attorney Service Provider are parties to the Professional <br /> Services Agreement dated August 11, 2015, as amended (the "Agreement"), under which <br /> Attorney Service Provider provided public defense oversight services during the later <br /> portion of 2015, and years 2016, 2017 and 2018. <br /> B. The City and the Attorney Service Provider desire to amend the <br /> Agreement so that Attorney Service Provider will also provide the public defense <br /> oversight services during calendar year 2019. <br /> AGREEMENT <br /> The City and Attorney Service Provider agree as follows: <br /> 1. The Agreement is modified so that the expiration of the Agreement is December <br /> 31, 2019. For 2019 Work, the Attorney Service Provider shall provide two <br /> reports, one due July 1, 2019, and the second due December 31, 2019. <br /> 2. Section 4 of the Agreement as amended is further modified by adding the <br /> underlined phrase as set forth below: <br /> Compensation. The City shall pay the Attorney Service Provider$150.00 <br /> per hour, up to a total cumulative maximum of$45,000 for Work in 2015, <br /> and up to a total cumulative maximum of$30,000 for Work in 2016, and <br /> up to a total cumulative maximum of$30,000 for Work in 2017, and up to <br /> a total cumulative maximum of $24,000 for Work in 2018, and up to a <br /> total cumulative maximum of$24,000 for Work in 2019. This payment is <br /> full compensation for such Work performed and services rendered, <br /> including, but not limited to, all labor, materials, supplies, equipment and <br /> incidentals necessary to complete the Work. <br /> 3. Regardless of the date(s) on which this Amendment is signed by the parties, the <br /> parties agree that the Agreement has been continuously in effect since August 11, <br /> 2015. <br /> 4. All provisions in the Agreement shall remain in effect except as expressly <br /> modified by this Amendment. <br />
