An opinion of the Agency's attorney that the interest for which the <br /> exception is sought would not violate state or local law. <br /> The County will review the request of the Agency and will submit the <br /> request for an exception to HUD if the request meets the criteria listed <br /> above. <br /> e. Factors to be Considered for Exceptions <br /> The factors to be considered by the County in determining whether to <br /> submit an exception request shall be the same as those considered by <br /> HUD in determining whether to grant a requested exception and are <br /> contained at 24 CFR § 92.356(e). <br /> 2. Conflict of Interest in HOME-Assisted Housing <br /> a. Applicability <br /> No officer, employee, agent or consultant of the Agency may occupy <br /> any HOME-assisted unit. <br /> b. Exceptions <br /> Upon written request of the Agency, the County may grant an <br /> exception to the provisions of paragraph (a) of this section on a case- <br /> by-case basis when it determines the exception will serve to further the <br /> purposes of the HOME Program and the effective and efficient <br /> administration of the HOME-assisted project. <br /> c. Factors to be Considered for Exceptions <br /> The factors to be considered by the County in determining whether to <br /> grant a requested exception under paragraph (b) of this section are <br /> contained at 24 CFR § 92.356(f)(2). <br /> L. Public Information <br /> In all news releases and other public notices related to the Project funded <br /> under this HOME Agreement, the Agency shall include information identifying <br /> the source of funds as the Snohomish County HOME Investment <br /> Partnerships Program. <br /> M. HOME Match Requirements <br /> HOME matching contribution requirements of 24 CFR §§ 92.218-92.222 <br /> apply to HOME funds.
