CITY OF EVERETT SPECIAL PROVISIONS <br /> On all projects funded with City funds only, the Contractor shall certify to the actual <br /> amounts paid Disadvantaged, Minority, or Women's Business Enterprise firms that <br /> were used as subcontractors, lower tier subcontractors, manufacturers, regular <br /> dealers, or service providers on the Contract. This certification shall be submitted to <br /> the Engineer on WSDOT form 140-542 within 20 calendar days after physical <br /> completion of the Contract. <br /> Supplement 1-08.1 by adding the following: <br /> The Contract Documents shall apply to Subcontractors and suppliers as if each had <br /> signed the Contract with the City. Contractor shall include the provisions of these <br /> Contract Documents or a "flow down" clause in each contract with Subcontractors and <br /> suppliers. <br /> The City will not approve a Subcontractor that is also providing services to the City on <br /> the same project. <br /> No Subcontractor or lower tier subcontractor will be permitted to perform Work under <br /> the Contract until the following documents have been completed and submitted to the <br /> Engineer: <br /> 1. Request to Sublet Work (Form 421-012), and <br /> 2. Contractor and Subcontractor or Lower Tier Subcontractor Certification for <br /> Federal-aid Projects (Form 420-004). <br /> The Contractor's records pertaining to the requirements of this Special Provision shall <br /> be open to inspection or audit by representatives of the City during the life of the <br /> Contract and for a period of not less than three years after the date of acceptance of <br /> the Contract. The Contractor shall retain these records for that period. The Contractor <br /> shall also guarantee that these records of all Subcontractors and lower tier <br /> subcontractors shall be available and open to similar inspection or audit for the same <br /> time period. <br /> Contractor shall not sublet to a single Subcontractor more than one-half of the Project. I <br /> The City may refuse to approve any subcontract for any reason. Subcontractors will <br /> be considered agents of the Contractor and their work shall be subject to the <br /> provisions of the Contract. References in the Contract Documents to actions required <br /> of Subcontractors, manufacturers, suppliers, or any person other than the Contractor, <br /> the City or the City's Representative shall be interpreted as requiring that the <br /> Contractor shall require such Subcontractor, manufacturer, supplier or vperson to <br /> perform the specified action. <br /> 1-08.3 Progress Schedule <br /> 1-08.3(1) General Requirements I <br /> Delete 1-08.3(1) and substitute the following: <br /> 1-08.3(1) General <br /> (******) <br /> Because time is of the essence, diligent and expeditious progress and completion of <br /> the Work by the Contract Completion Date is required of the Contractor. Careful, <br /> adequate, accurate and complete planning and scheduling of the Work by the <br /> Contractor, both prior to the start of, and throughout, construction, is vital to the <br /> success of this Project for both the Contractor and the City. The purposes of the <br /> schedules and reports include: <br /> 1. Ensuring adequate planning and execution of the Work by the Contractor. <br /> 2.
