I <br /> ICITY OF EVERETT, WASHINGTON <br /> IDIVISION C - CONTRACT <br /> THIS CONTRACT is made and entered into this `j t%\ day of OtCr:rnB£R , 2018, by and between <br /> I the City of Everett, Washington, a municipal corporation existing under the laws of the State of <br /> Washington, hereinafter called the "City," and <br /> 1 v.+r'�C2w-S'1 Co N SI-Rua-r o� NL- a <br /> W P,S+�k�-o CORfo R ASI oN , hereinafter called the"Contractor." <br /> IIn consideration of the sums to be paid to it by the City, Contractor hereby covenants and agrees to furnish <br /> all labor, tools, materials, equipment, and supplies required to build and construct and to build and <br /> I construct in a workmanlike manner the work, improvements, and appurtenances in accordance with the <br /> Specifications and Plans entitled: WATERMAIN REPLACEMENT"T"-UP3684 (the"Project"). <br /> 1. Contract Documents. The following documents ("Contract Documents") are incorporated by <br /> Ireference and are hereby made a part of this Contract: <br /> A. Notice to Contractors <br /> IB. Instructions to Bidders (if any) <br /> C. Washington State Department of Transportation Standard Specifications 2016 as modified <br /> by all amendments thereto as of the date of bid opening of this Project ("Standard <br /> ISpecifications"). <br /> D. Special Provisions <br /> I E. Plans, Drawings and Project Specifications <br /> F. Addenda(if any) <br /> G. Payment Bond and Performance Bond <br /> IH. Contractor's Proposal/Bid (conformed copy dated II - 1-3 - aZ01ir ) <br /> I. All provisions required by law whether set forth and reproduced herein or not <br /> I 2. Time for Completion. Substantial completion for work required under Schedule A-Watermain shall <br /> be achieved within 100 working days of the effective date of the Notice to Proceed for Schedule A - <br /> Watermain. Substantial completion for work required under Schedule B - Shoulder Restoration shall be <br /> I achieved within 20 working days of the effective date of the Notice to Proceed for Schedule B-Shoulder <br /> Restoration. Physical completion for each Schedule shall be within 20 working days of the actual date <br /> of issuance of substantial completion of each Schedule. <br /> I A. Milestone 1. Full and complete water service needs to be provided to the Cocoon House, <br /> 3530 Colby Avenue, by February 16, 2019. If this water service is not provided for any reason by <br /> such date, then (1) the City may with its own forces or otherwise provide the water service to <br /> I Cocoon House, with the means, methods, design, materials and schedule of the work at the City's <br /> sole discretion; (2) the City's work to provide Cocoon House water will take priority over the <br /> Project and the City has no obligation to coordinate work with the Project, with the Contractor in <br /> no event receiving any compensation or extra working days for delays or other damages to <br /> I Contractor that may arise from or relate to the City's work to provide Cocoon House water service; <br /> and (3) the Contractor will pay the City all of the City's costs for the City's work for Cocoon <br /> House water service (including without limitation staff time and overtime costs) plus a 30% <br /> I administration fee, all of which the City may deduct from payments due to Contractor under this <br /> Contract. <br /> 3. Liquidated Damages. The parties agree the City will suffer damage and be put to additional expense <br /> in the event that the Contractor does not complete the work in all respects and have it ready for use by the <br /> Watermain Replacement"T" Division C-CONTRACT October 10, 2018 <br /> I <br /> WO No. - UP3684 SP—33 <br />
