RESPONSIVENESS: City will consider all the material submitted by the bidder to determine whether it is in compliance with the Contract Documents. The City reserves the right, at its discretion, to reject nonresponsive Bids. c. RESPONSIBILITY: 1) Mandatory Responsibility Criteria: RCW 39.04.350(1). It is the intent of City to award a contract to the lowest responsive and responsible Bidder. Before award, the Bidder must meet the Bidder responsibility I criteria under this Section 1.13.A.1.c.(1) to be considered a responsible Bidder. The Bidder may be required by the City to submit documentation demonstrating compliance with the criteria under this I Section 1.13.A.1.c.(1). The Bidder must: a) Registration. Have a current certificate of registration as a contractor in compliance with chapter 18.27 RCW, which must I have been in effect at the time of bid submittal; and b) UBI. Have a current Washington Unified Business Identifier (UBI) number; and I 2) State Requirements. If applicable: a) Have Industrial Insurance (workers' compensation) coverage for the bidder's employees working in Washington, as required in Title 51 RCW; I b) Have a Washington Employment Security Department number, as required in Title 50 RCW; c) Have a Washington Department of Revenue state excise tax I registration number, as required in Title 82 RCW; and 3) Disqualification. Not be disqualified from bidding on any public works contract under RCW 39.06.010 or 39.12.065(3). I 4) Apprentices. If the Project is subject to the apprenticeship utilization requirements in RCW 39.04.320, not have been found out of compliance by the Washington state apprenticeship and training I council for working apprentices out of ratio, without appropriate supervision, or outside their approved work processes as outlined in their standards of apprenticeship under chapter 49.04 RCW for the one-year period immediately preceding the date of the bid solicitation. I 5) Off-Site Pre-Fabricated Items. Not have violated RCW 39.04.370 more than one time as determined by the Department of Labor and Industries. I 6) Supplemental Bidder Responsibility Criteria: RCW 39.04.350(2). If this Project is subject to supplemental bidder responsibility criteria, then such criteria will be contained in SECTION 002213, I SUPPLEMENTAL INSTRUCTIONS TO BIDDERS. If there is no SECTION 002213, SUPPLEMENTAL INSTRUCTIONS TO BIDDERS in the bid package, then the Project is not subject to supplemental bidder responsibility criteria. I d.
