S
FINDINGS AND DECISION
OF THE HEARING EXAMINER PRO TEM OF THE
CITY OF EVERETT
IN THE MATTER OF THE APPLICATION
OF SPECIAL INTEREST AUTOBODY FOR
APPROVAL OF AN EXPANSION OF A
NON-CONFORMING USE REV III #14-001
SUMMARY OF DECISION: The requested expansion of the
nonconforming use as detailed in the following
findings is approved with conditions.
INTRODUCTION
Special Interest Autobody (Applicant), currently doing business at 6326, 6400, 6408, and
6410 Evergreen Way, proposes to expand its auto body repair business into the existing
buildings at 6500 Evergreen Way. They also seek after the fact authorization for the
expansion of the use into a previously built addition onto the building at 6408 Evergreen
Way. Because auto body repair is not a permitted use in the MUO zone, the existing
business is a legally nonconforming use. Expansion of the floor area housing a
nonconforming use by more than 25% requires approval by the Hearing Examiner.
A hearing on the request was held before the Hearing Examiner Pro Tern of the City of
Everett on May 21, 2015. At the hearing the following presented testimony and
evidence:
Steve Ingalsbe, City of Everett Planning Department
Shayne Hedahl
Special Interest Autobody
6400 Evergreen Way
Everett, WA 98203
Gabrielle Muller
CB Anderson Architects
4907 Meridian Avenue N
Seattle, WA 98103
Eldon Wexler
1101 Avenue D #201
Snohomish, WA 98290
At the hearing the following exhibits were submitted and were admitted as part of the
official record of these proceedings:
