) <br /> FINDINGS AND DECISION <br /> OF THE HEARING EXAMINER PRO TEM OF THE <br /> CITY OF EVERETT <br /> IN THE MATTER OF THE APPLICATION <br /> OF SPECIAL INTEREST AUTOBODY FOR <br /> APPROVAL OF AN EXPANSION OF A <br /> NON-CONFORMING USE REV III #14-001 <br /> SUMMARY OF DECISION: The requested expansion of the <br /> nonconforming use as detailed in the following <br /> findings is approved with conditions. <br /> INTRODUCTION <br /> Special Interest Autobody (Applicant), currently doing business at 6326, 6400, 6408, and <br /> 6410 Evergreen Way, proposes to expand its auto body repair business into the existing <br /> buildings at 6500 Evergreen Way. They also seek after the fact authorization for the <br /> expansion of the use into a previously built addition onto the building at 6408 Evergreen <br /> Way. Because auto body repair is not a permitted use in the MUO zone, the existing <br /> business is a legally nonconforming use. Expansion of the floor area housing a <br /> nonconforming use by more than 25% requires approval by the Hearing Examiner. <br /> A hearing on the request was held before the Hearing Examiner Pro Tern of the City of <br /> Everett on May 21, 2015.
