ORDER <br /> Having reviewed the foregoing stipulation and papers on file in this matter, the Hearing <br /> Examiner adopts the stipulated facts as findings, concludes that the violation stated in <br /> the notice of violation did occur and has been abated, and <br /> DOES HEREBY ORDER: <br /> 1. The Respondent was found to be in violation of IPMC 604.1, IPMC 601.2, IPMC <br /> 108.1.4, IBC 105.1 and EMC 8.20.020(A). The Respondent has abated the <br /> violations described in the violation citation by September 30, 2014 which included <br /> immediately vacating the structure on site and maintaining vacancy until approved <br /> electrical service is restored, applying for and obtaining required City permits and <br /> removing and properly disposing of the discarded junk, trash and garbage from the <br /> rear lot of the property. <br /> 2. The Respondent is assessed a fine of$500.00 for violations of IPMC 604.1, IPMC <br /> 601.2, IPMC 108.1.4, IBC 105.1 and EMC 8.20.020(A)for a total fine of$2000.00. <br /> The total fine of$2000.00 is hereby suspended for two years from the date of this <br /> Order on the condition that there are no violations of the EMC on the property. If <br /> within two years of the date of this Order the property is found to be in violation of <br /> any property maintenance or nuisance provision of the EMC the suspension of fines <br /> will be lifted and the fines will be due immediately. <br /> 3. This written Order shall be controlling over any conflicts with oral Orders issued at <br /> the Public Hearing. <br /> Violation of this Order is a misdemeanor offense EMC §1.20.080. <br /> Entered this 2nd day of October, 2014. <br /> IPfines M.
