1. GENERAL INFORMATION <br /> 1.1 DEFINITIONS OF WORDS AND TERMS <br /> Where used in the Contract Documents, the following words and terms shall have the meanings <br /> indicated. The meanings shall be applicable to the singular, plural, masculine and feminine of all words <br /> and terms. <br /> Change Order: Reference to Change Order shall include all rights of the Owner and Contractor under <br /> section 6. CHANGES. <br /> Completion Date: Date on which Project is ready for Final Acceptance. All physical work, including <br /> Punch List, is complete and Contractor has completed and fulfilled all contractual obligations except any <br /> maintenance of landscaping. Contractual obligations that must be fulfilled prior to achievement of the <br /> Completion Date include, but are not limited to, the Contractor's furnishing all documentation (including <br /> correct, complete and accurate as-built or record drawings)and operation and maintenance manuals and <br /> transfer of warranties. <br /> Contract: Agreement signed by the Owner and Contractor(Section 00500). <br /> Contract Claim: Any request by the Contractor for additional time or money(adjustment of Contract <br /> Sum or Contract Time) irrespective of the cause or reason for the request. Contract Claims include, but <br /> are not limited to, requests by the Contractor for additional time or money due to Extra Work, <br /> inefficiencies, delays, interferences, and problems with the design. Contract Claim includes, but is not <br /> limited to, claims or requests by subcontractors for extensions of Contract Time, adjustment of Contract <br /> Sum, additional compensation that the Contractor attempts to pass through or assert against the Owner, <br /> or claims against the Owner arising out of a third party's claim against the Contractor.. <br /> Contract Documents: Documents constituting the Contract as described in section 1.2. Contract <br /> Documents below. <br /> Contract Sum: The price in dollars stated in the Contract to be paid by the Owner to the Contractor for <br /> the Work described in the Contract Documents, as modified by any Change Orders. <br /> Contract Time: The duration of the Project as stated in the Contract and as modified by any Change <br /> Orders. <br /> Day: Calendar day, unless explicitly stated otherwise. <br /> Delay: Any increase of the duration of the critical path of the Project. <br /> Dispute: Any controversy or disagreement. <br /> Engineer: The individual or entity retained by the Owner to be the Owners representative with regard to <br /> matters of design intent. <br /> Equipment: Mechanical, electrical, instrumentation, or other devices with one or more moving parts, or <br /> devices requiring an electrical, pneumatic, electronic, or hydraulic connection. <br /> Extended Overhead:The increase in Overhead costs attributable to an extension of Contract Time. <br /> Extra Work: Providing materials and Equipment and the performance of work not directly called for in, or <br /> implied by, the Contract Documents, such that Contractor would be entitled to an adjustment of Contract <br /> 1 Sum and possibly an extension of Contract Time. <br /> Field Order: A written order issued by Engineer which requires minor changes in the Work but which <br /> does not involve a change in the Contract Price or the Contract Times. <br /> Final Acceptance: Formal action by Everett City Council determining that all of the Contractor's Work <br /> has been completed, except for any landscaping maintenance. <br /> Float: The amount of time between the early start date and the late start date, or the early finish date and <br /> the late finish date of any activity in the project schedule. <br /> Force Account: Costs of performing Work as defined in section 9.6.
