Conrm�..�i� ��� (hereinafter referred to as "Bank") whose <br />address is /�L5 8oX i� ��7 �'� b`/� ce� A- , in the <br />name of Gv �7�o i� %��Co7�-s Lt-C to assure performance of the above <br />described improvements and guarantee that these funds will not }.e released without prior written <br />approval from �he City of Everett Department of Planning and Community Development <br />(hereinafter referred to as "City"). We agree that upon completion of the installation of the above <br />described improvements, per City standards and approval by the City, the City will provide <br />written notice to the Bank authorizing the release of these funds. We further agree that these <br />funds will be released to the City upon notice by the City that the improvements have not been <br />installed per City standards after the date listed in paragraph one of this agreement; provided, <br />however, if the City determines that an action or inaction associated with this agreement has <br />created an emergency situation endangering the public health, safety, or welfare, creating a <br />potential liability for the City, or endangering City streets, utilities, or property, then not <br />withstanding the date listed in paragraph one of this agreement, we further agree that these funds <br />will be released to the City upon notice by the City that the improvements have not been installed <br />per City standards and ihat an emergency exists which requires their immediate release. <br />Provided further, however, that in the event the above described improvements are <br />installed per City standards and a certificate of partial compliance is signed by the City, then in <br />or�g�.�a/ 1a L,t G�ee�lw(�ey� J'I9AA��Lj /G-Jd-OI <br />
