FIRST AMENDMENT TO <br /> INTERGOVERNMENTAL AGREEMENT <br /> "SNOHOMISH COUNTY FIRE TRAINING ACADEMY (SCFTA)" <br /> Comprised of the following governmental entities ("Participating Entities") ("Parties"): <br /> City of Arlington <br /> City of Everett <br /> City of Mukilteo <br /> Lake Stevens Fire <br /> Marysville Fire District <br /> North County Regional Fire Authority <br /> South Snohomish County Fire and Rescue Regional Fire Authority <br /> Snohomish County Fire District 4 <br /> Snohomish County Fire District 7 <br /> Snohomish County Fire District 19 <br /> WHEREAS, the parties entered into an Interlocal Agreement dated February 1, 2018 <br /> (the "Agreement"); and <br /> WHEREAS, the parties now desire to make certain amendments to the Agreement as <br /> provided herein. <br /> 1. A new bullet is hereby added to Section 3.3 as follows:. <br /> Effective February 6, 2019, when a Participating Entity provides an Engine for academy use, <br /> the Participating Entity will be entitled to a Reimbursable Expense of$75.00 per day for each <br /> day that Engine was in actual use by the academy. <br /> 2. Section 2.1 is hereby deleted and replaced with the following: <br /> Equipment and Engines. Each Participating Entity which provides Equipment or Engines for <br /> academy use shall be responsible for the maintenance, repair or replacement of such Equipment <br /> and/or Engines in compliance with that Participating Entity's policies and best practices. Such <br /> Equipment and/or Engines shall be maintained in a safe and reliable condition by the owner. <br /> When a Participating Entity becomes aware of any damage or maintenance issue, the <br /> Participating Entity shall promptly notify the Joint Board and the owner of the Equipment or <br /> Engine. Each Participating Entity providing an Engine for the SCFTA shall be responsible for fuel <br /> costs. • <br /> 3. Section 2.5 of the Agreement is hereby deleted and replaced with the following: <br /> Any vehicle used in training exercises shall be operated by an employee of the Participating <br /> Entity providing the vehicle, or an academy Company Officer that is certified within the state of <br /> Washington with Driver/Operator credentialing. <br /> 4. Section 2.6.1 of the Agreement is hereby deleted and replaced with the following: <br /> The SCFTA shall notify the respective owner immediately of any damage to their respective <br /> facilities, equipment, Engines, vehicles, props or other property other than ordinary wear and <br /> tear. The owner will have such damage repaired or in the event repair would be unfeasible, the <br /> owner will replace the damaged item with a like item (see Article 3.3 herein). If such damage or <br /> destruction was caused by the misuse,.abuse or negligence of a Participating Entity, then the <br /> provisions of Section 6 herein shall apply.' 34 <br />
