AGENCIES WITH JURISDICTION <br /> • Washington State Department of Ecology, NPDES Permit. <br /> • U.S.Army Corps of Engineers Nationwide Fill Permit <br /> APPLICABLE CONDITIONS FROM SW EVERETT MITIGATION DECISION DOCUMENT <br /> Section 1: LAND USE <br /> 1.3 Mitigation Measures <br /> 1. Height All development with structures more than 200 feet in height and those within 20,000 feet of <br /> Paine Field must check with the FAA to determine if notification is required. <br /> 2. Rockeries and retaining walls greater than 4 feet in height and 40 feet in length that are visible from <br /> adjacent properties or public right of way shall be substantially screened with landscaping or <br /> architecturally designed and landscaped to break up the appearance of length/height in a manner <br /> approved by the Planning Director. Rockeries and retaining walls within required landscape areas <br /> shall not be counted in the required landscaping width. <br /> 3. If any archaeological resources or human remains are found during construction,the project <br /> proponent shall contact the Tulalip Tribes,the City of Everett Planning and Community Development <br /> Department,and the State Office of Archaeology and Historic Preservation. This contact will initiate <br /> a consultation process for determining subsequent actions. <br /> Section 2: TRANSPORTATION <br /> 2.3 Mitigation Measures <br /> 1. All development must pay a fee of$1,006.00 per PM peak hour trip to fund system-wide <br /> transportation improvements. <br /> 2. Unless otherwise approved by the City Traffic Engineer,each development must submit a design <br /> traffic study that analyzes access capacity,site-specific safety issues, and site-specific construction <br /> impacts. The Traffic Engineer will use this study to set the design criteria that will apply to <br /> development proposals. Improvements necessary for safe and adequate access to a site are the <br /> responsibility of the developer, including traffic signals and roadways installed to provide direct <br /> access to a site. Facilities such as bus stops and shelters may also be required. Decisions by the <br /> Traffic Engineer may be appealed to the Hearing Examiner. <br /> 3. Transit routes/schedules and high occupancy vehicle,information must be prominently displayed for <br /> employees at on-site commute information centers and near associated walkways. Preferential <br /> parking space locations for carpools and vanpools must be provided on all sites. Buildings must <br /> incorporate bicycle and pedestrian amenities such as lockers,shower rooms,and bicycle stands. <br /> Section 3: EARTH1GEOLOGICALLY HAZARDOUS AREAS <br /> Sites designated as geologically hazardous areas may be modified if approved by the Planning Director <br /> based upon review of a geotechnical report that shows the proposal meets the criteria of Section 37 of <br /> the Zoning Cade. The report must show that the modifications will not create a hazard to the subject <br /> property or surrounding properties. <br /> The EIS does not evaluate the impacts of earth removed from the Subarea and placed on sites outside of <br /> the Subarea. Additional SEPA analysis will be required for placement of fill outside the Subarea. <br />
