TO POSTING r_�___-Z�-a� THIS AGREEMENT entered into this 2 4 t h day of bIarch 19 95 , by and between the City of Everett, a municipal corporation under the laws of the State of Washington, hereinafter referred to as "City," and Ramona Boylan "Owner." WITNESSETH: hereinafter referred to as WHEREAS, Owner owns property at 6919 evergreen Way Everett, Washington, which is located in the County of Snohomish and legally described as follows: Lot 11, Block 5 Plat of Beverly Hills Division 1 Parcel #3928 005 011 00 09 ; and WHEREAS, Owner desires to convert a single family residence into an office and small drive-thru restaurant ; and WHEREAS, EMC 14.08.1800) authorizes the City Engineer to waive strict compliance with the provisions of EMC 14.08 when he deems physical conditions render compliance impracticable provided the Owner agrees to save harmless and indemnify the City; and WHEREAS, Owner requests a variance to utilize the existin side -sewer rather than convert to 6" diameter line as reouired for a commercial use ; and WHEREAS, in lieu of being required to make the necessary physical changes to accommodate the provisions of EMC 14.08, which the City Engineer finds {� renders compliance impracticable, Owner agrees to save harmless and indemnify tr1' the City;
