Kirk&-ooks <br />52 oo - Ceda, S+, <br />FOR SEWER CONNECTION VARIANCE Euerdf j Wel. 98201. <br />TO POSTING r_�___-Z�-a� <br />THIS AGREEMENT entered into this 2 4 t h day of bIarch <br />19 95 , by and between the City of Everett, a municipal corporation under the <br />laws of the State of Washington, hereinafter referred to as "City," and <br />Ramona Boylan <br />"Owner." <br />WITNESSETH: <br />hereinafter referred to as <br />WHEREAS, Owner owns property at 6919 evergreen Way <br />Everett, Washington, which is located in the County of Snohomish and legally <br />described as follows: <br />Lot 11, Block 5 Plat of Beverly Hills Division 1 <br />Parcel #3928 005 011 00 09 <br />; and <br />WHEREAS, Owner desires to <br />convert a single family residence <br />into an office and small drive-thru restaurant <br />; and <br />WHEREAS, EMC 14.08.1800) authorizes the City Engineer to waive strict <br />compliance with the provisions of EMC 14.08 when he deems physical conditions <br />render compliance impracticable provided the Owner agrees to save harmless and <br />indemnify the City; and <br />WHEREAS, Owner requests a variance to utilize the existin <br />side -sewer rather than convert to 6" diameter line as <br />reouired for a commercial use <br />; and <br />WHEREAS, in lieu of being required to make the necessary physical changes <br />to accommodate the provisions of EMC 14.08, which the City Engineer finds {� <br />renders compliance impracticable, Owner agrees to save harmless and indemnify tr1' <br />the City; <br />
