CITY LICENSE TO USE CITY PROPERTY Grantor: City of Everett (hereinafter referred to "City") Grantee: FUN TIMES ICE CREAM Property: Those certain premises commonly known as Thornton A. Sullivan Park and Forest Park, (hereinafter called "Premises" or the "property"), being situated at the following location in Everett, Washington legally described as: Thornton A. Sullivan Park Forest Park 11405 Silver Lake Dr. 802 East. Mukilteo Blvd Everett, WA 98208 Everett, WA 98203 Situated in the County of Snohomish, State of Washington. 1. AUTHORIZED USE. FUN TIMES ICE CREAM shall use the Premises for conducting concession operations open to the public. 2. TERM. This License shall be effective on April 20, 2019, and shall expire on September 30, 2019. 3. FEE. FUN TIMES ICE CREAM shall pay the City a monthly fee of$25 (twenty five dollars) for April; $25 (twenty five dollars) for May; $225 (two hundred and twenty five dollars) for June; $900 (nine hundred dollars) for July and August, and $50 (fifty dollars) for September. Payments shall be made on or before the 5th of each month in which payment is due. A late fee penalty of$50 (fifty dollars) will be assessed for payments received after the 5th of each month. The license is subject to a leasehold tax. Leasehold tax is included in the fee. 4. AUTHORIZED USE. FUN TIMES ICE CREAM may only use the property for the purpose of conducting concession operations. 5. INDEMNIFICATION. To the extent of its fault, the FUN TIMES ICE CREAM hereby agrees to defend, indemnify and hold the City harmless from any and all Claims for injury to people or damage to property arising out of or related to this License. "City" means the City, its officers, employees and agents. ii Page
