J I <br /> 1 ORDINANCE NO. 1/07 ---)6 <br /> 2 <br /> 3 AN ORDINANCE amending Ordinance No. 123-71 and sec- <br /> tions of Title 46 of the Everett City Code relating <br /> 4 to and regulating motor vehicles, traffic, and <br /> transportation and their incidents upon the public <br /> 5 streets, bicycle paths, and other ways open to the <br /> public within the City of Everett; prescribing <br /> 6 powers and duties of officers and others in rela- <br /> tion thereto; defining officers; providing penal- . <br /> 7 ties, and declaring an emergency to exist. <br /> 8 <br /> 9 WHEREAS, the adoption of Ordinance 123-71 and subsequent amending <br /> ordinance inadvertently omitted the adoption of RCW 46.61.440, maximum <br /> 10 speed limit when passing school or playground crosswalks; and <br /> 11 WHEREAS, the City Council does desire that this section be included <br /> in Title 46, Traffic Code of the Everett Municipal Code, <br /> 12 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN <br /> 13 <br /> Section 1: That Chapter 46.61, Rules of the Road: Obedience to <br /> 14 and Effect of Traffic Laws of Ordinance 123-71 and Title 46 of the <br /> Everett Municipal Code be amended to include Section 46.61.440, Maximum <br /> 15 Speed Limit When Passing School or Playground Crosswalks (as follows) : <br /> 16 Subject to RCW 46.61.400 (1), and except in those instances <br /> where a lower maximum lawful speed is provided by this chap- <br /> 17 ter or otherwise, it shall be unlawful for the operator of <br /> any vehicle to operate the same at a speed in excess of <br /> 18 twenty miles per hour when operating any vehicle upon a <br /> public highway either inside or outside an incorporated <br /> 19 city or town when passing any marked public school or <br /> playground crosswalk when such marked crosswalk is fully <br /> 20 posted with standard portable school or speed control <br /> signs.
