<br />   						AN ORDINANCE granting to Washington Natural Gas Company,
<br />     							its successors and assigns, a gas franchise, and
<br />     							imposing provisions and conditions relating thereto.
<br />       		1
<br />       		2		THE CITY OF EVERETT DOES ORDAIN:
<br />       		3		Section  1:   The City of Everett in Snohomish County, Washington,  (herein
<br />       		4     called the "Grantor") hereby grants to Washington Natural Gas, a Delaware cor-
<br />       		s      poration,  (herein called the "Grantee") , its successors and assigns, for the full
<br />       		6
<br />      			term of twenty-five (25) years from the date of acceptance hereof by said Grantee,
<br />       		7
<br />      			the right, privilege and authority or franchise to construct or otherwise acquire
<br />       		8
<br />      			and to own, maintain, equip and operate plants and works , and all necessary or
<br />       		9
<br />      		10     desirable appurtenances thereto, for the manufacture, generation, purchase,
<br />      		11      transmission and distribution of artificial, natural and/or mixed gas (herein
<br />      		12     referred to generally as "gas") , including the right to construct, lay, extend,
<br />      		13      maintain, renew, remove, replace, repair, use and operate gas pipes and gas
<br />      		14
<br />       			mains, and all appurtenances and appendages thereto, in, under or on or across
<br />      		15
<br />      			the present and future public streets , avenues, alleys , highways, bridges,
<br />      		16
<br />       			easements and other public places within the present or any future corporate
<br />      		17
<br />       			limits of the Grantor or its successors, for the purpose of distributing, supplying
<br />      		18
<br />      		19     and selling gas to Grantor or its successors , and to persons and corporations
<br />      		20     inhabitants thereof, as well as to persons or corporations beyond the present
<br />      		21      or future corporate limits thereof.
<br />      		22		Section  2:     (a)  Grantee's facilities shall be so located or relocated and
<br />      		23      so erected as to interfere as little as possible with traffic over said streets,
<br />      		24
<br />       			avenues, alleys, highways, bridges, easements and other public places , and
<br />      		25
<br />       			with reasonable egress from and ingress to abutting property provided however
<br />      		26
<br />      			that Grantee shall not break up or obstruct any street, alley, or public thorough-
<br />      		27
<br />       			fare, except in emergencies , without permission from the City Engineer.  When
<br />     		28
<br />      		29     any portion of a street is excavated by Grantees in the location, relocation, re-
<br />      		30     placement or repair of any of its facilities, the portion of the street so excavated
<br />     		31     shall, within a reasonable time and as early as practicable after such excavation,
