* . •� '1 <br /> 1 request the same and agree to abide by Grantee's reasonable rules and regula- <br /> 2 tions, and shall acquire, construct, maintain and equip and operate all necessary <br /> 3 facilities for the manufacture, generation, purchase, transmission, sale, supply <br /> 4 <br /> and distribution of gas for the benefit and convenience of Grantor and its inhabi- <br /> 5 <br /> tants, and shall make promptly such extensions to existing facilities as may be <br /> 6 <br /> required by one or more customers, or prospective customers , provided that if <br /> 7 <br /> 8 the revenues to be derived from such extensions shall not afford a fair and rea- <br /> sonable return on the cost of providingand renderingthe required service, <br /> 9 q <br /> 10 then Grantee shall be permitted to, and is hereby authorized to exact from such <br /> 11 customer, or customers, such cash advances, minimum guarantees , service <br /> 12 guarantees or other arrangements, as will enable Grantee to earn a fair and <br /> 13 reasonable return on the cost of providing and rendering the required service. <br /> 14 <br /> Section 4: The City Council of Grantor shall have the right to hear and <br /> 15 <br /> determine what are just, fair and reasonable rates, fares and charges for the <br /> 16 <br /> gas distribution service contemplated herein and to order that only reasonable <br /> 17 <br /> 18 charges shall be imposed, and to make effective such order by penalties and <br /> 19 forfeitures . However, it is understood at present that the United States Govern- <br /> 20 ment, the government of the State of Washington, and designated agencies <br /> 21 operating under the authority of said governments have now exclusive juris- <br /> 22 diction to hear, determine, and make necessary orders concerning said rates, <br /> 23 <br /> fates and charges and, therefore, during the period of time this condition exists, <br /> 24 <br /> the foregoing power of the City Council of Grantor shall be held in abeyance and <br /> 25 <br /> be without effect. In the event said City Council of Grantor again becomes <br /> 26 <br /> 27 authorized to hear, determine and make applicable orders concerning said rates, <br /> 28 fares and charges, then the said foregoing power shall be revived and be <br /> 29 effective. The granting of the franchise herein shall not confer any right upon <br /> 30 the Grantee to include in the charge for its service hereunder any return upon <br /> 31 the value of the franchise granted herein and Grantee agrees not to include such <br /> 32 <br /> -3- <br />
