ORDINANCE NO. <br /> AN ORDINANCE reaffirming zoning classifications <br /> for certain areas of the City as originally estab- <br /> lished by Ordinance 3770, passed August 2, 1960 <br /> 1 WHEREAS , the City Council of the City of Everett did annex a <br /> certain area of the City known as the Madison Annexation on December 31, <br /> 2 1959 and, <br /> 3 WHEREAS , the City Council did, on August 2 , 1960, adopt <br /> 4 Ordinance No. 3770 establishing zoning classifications for all areas within <br /> the Madison Annexation, and <br /> 5 <br /> WHEREAS , a decision by the Snohomish County Superior Court <br /> 6 disputes the validity of said Ordinance 3770 due to the absence of a formal <br /> public hearing by Council in 1960, and <br /> 7 <br /> 8 WHEREAS , the City Council deems it in the best interest of the <br /> community to reaffirm said zoning within the Madison Annexation area; <br /> 9 <br /> NOW THEREFORE THE CITY COUNCIL DOES ORDAIN: <br /> 10 <br /> Section 1: That the zoning on the following described property is <br /> 11 hereby reaffirmed as follows: <br /> 12 R-1, SINGLE FAMILY LOW DENSITY RESIDENCE ZONE <br /> 13 Begin at the intersection of center line 52nd St. and center line Colby <br /> 14 Ave.; th S. alg. Colby Ave. to the n.p.l. of Plat of N. Beverly Park <br /> Div. No. 2 extended east; th W along the n.p.l. of N. Beverly Park <br /> 15 Div. No. 2 and the n.p.l. Blk. 1 and 2 of Beverly Hills Div. No. 2 <br /> to the SE cor. Blk. 3 , Bev. Hills Div.
