ORDINANCE NO. 377 7j AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF PAINE AVENUE AND A PORTION OF THE ALLEY EAST OF PAINE AVENUE WHEREAS, by Resolution No. 1082 of the City of Everett, the City Council has declared its intentions to vacate said right-of-way; and WHEREAS, the City Council of the City of Everett did by resolution duly adopted, fix the 19th day of November, 1975, at 10:00 a.m. of said day, for the hearing, and determination of said Resolution; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said Resolution has been given out in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing favor- able statements and objections to the vacating of the herein described right-of-way were heard and discussed; and WHEREAS, it now appears to the City Council of the City of Everett, that the portion of said right-of-way resolved to be vacated should be vacated; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: A portion of Paine Street lying South of the North line of the Plat of J. S . Sines Acre Tracts and North of a line 58.04 feet South of the North line of said Plat and a portion of the alley in Block 6 of said Plat lying South of the North line of said Plat and North of a line 39.0 feet South of the North line of said Plat, be and the same is hereby vacated. SUBJECT to the following conditions and restrictions: That the City of Everett retains an easement to construct, op- erate, maintain, repair and replace all public utilities under, over and across all of said vacated property. The City of Everett further retains the right to grant to public utili- ties the right to construct, operate, maintain, repair and replace utility lines, including but not limited to telephone, gas and electrical, under, over and across all of said vacated property.
