i <br /> Ib. Contractor must provide a letter from its Corporate Risk Manager, or appropriate Finance <br /> Officer representing and warranting the following minimum information: whether the self- <br /> I insurance program is actuarially funded; the fund limits; any excess declaration pages to meet <br /> the Contract requirements; a description of how Contractor would protect and defend the Owner <br /> as an Additional Insured in their Self-Insured layer; and claims-handling directions in the event <br /> of a claim. <br /> I c. Any amounts due to,sought by, or paid to third party claimants shall be the sole responsibility of <br /> the Contractor, irrespective of whether such amount falls wholly within the level or amount of <br /> the Contractor's self-insured retention. <br /> ARTICLE 16 LAWS, REGULATIONS AND PERMITS <br /> A. GENERAL <br /> IA. The Contractor shall give the Notices required by law and comply with all laws, ordinances, rules and <br /> regulations pertaining to the conduct of the Work. <br /> 111 B. The Contractor shall be liable for violations of same in connection with Work provided by the Contractor; <br /> and Contractor shall cooperate with all governmental entities regarding inspection of the Work and <br /> compliance with such requirements. <br /> IC. If the Contractor observes that the Drawings, Specifications or other portions of the Contract Documents <br /> are at variance with any laws, ordinances,rules or regulations,he or she shall promptly notify the Owner's <br /> IRepresentative in writing of such variance. <br /> D, The Owner will promptly review the matter and, if necessary,take appropriate action. <br /> I E. Contractor agrees not to perform Work it knows, or in the exercise of ordinary care should know, to be <br /> contrary to any laws,ordinances,rules or regulations. <br /> B. PERMITS AND LICENSES <br /> I <br /> A. Securing and Payment. <br /> Unless otherwise specified, permits and licenses from governmental agencies, which are necessary <br /> II. <br /> only for and during the prosecution of the Work and the subsequent guarantee period, shall be secured <br /> by the Contractor and paid for by the Owner. <br /> 2. Permits and licenses of regulatory agencies that are necessary to be maintained after expiration of the <br /> Iguarantee period will be secured and paid for by the Owner. <br /> B. The City of Everett Utilities Department has reviewed and commented on the Drawings in this Contract. <br /> IC. Erosion Control Plan. <br /> 1. If required, submit an erosion control plan that depicts the best management practices that will be <br /> I followed for erosion control. <br /> a.
