CITY <br /> LEASE AGREEMENT <br /> This Lease is made this 3"( day of Op ri , 2019, between the City of Everett, a <br /> municipal corporation under the laws of the State of Washington, hereinafter referred to as the <br /> "City or Lessor", and Coffee Time, LLC, dba Tabby's Coffee Company and Dulcie Chase, <br /> individually (collectively "Lessee"). <br /> WITNESS <br /> 1. PREMISES. Lessor does hereby lease to Lessee, and Lessee does hereby lease from <br /> Lessor, approximately 1,320 square feet in the southeast entry area of the Everett Public Main <br /> Library, (hereinafter called"Premises"), being located at 2702 Hoyt Ave, Everett, Washington, <br /> 98201 and legally described as: <br /> Lots 28 thru 32, Block 623, Plat of Everett, according to the plat thereof recorded in <br /> Volume 3 of Plats, page 32, records of the Auditor, of the County of Snohomish, <br /> State of Washington. <br /> 2. TERM. This lease shall be effective upon execution, and end at midnight February <br /> 29, 2020. Any tenancy after the initial term shall be on a month to month basis. Except as <br /> otherwise provided in this Agreement, either party may terminate this agreement upon thirty (30) <br /> days written notification. <br /> 3. RENT. Lessee leases said Premises for said period and agrees to pay a monthly rental <br /> in the amount of$700.00 on or before the 10th day of each month during the term of this lease <br /> to: <br /> City Clerk <br /> City of Everett <br /> 2930 Wetmore <br /> Everett, WA 98201 <br /> or such other place as the Lessor may from time to time designate in writing. If any rent is, at <br /> any time, five (5) or more days past due, Lessee will be charged a late charge equal to ten (10) <br /> percent of the past due rental amount. All rent payments must be made without deduction or <br /> offset. <br /> 4. USE. Lessee may use and occupy said Premises for the purpose of coffee/espresso <br /> brewing and sales and sales of food products that are prepared either on or off site, Everett Art <br /> Walk events, and after hours and private events as approved in writing by the Library Director. <br /> The Library Director shall not unreasonably withhold approval for said events. Written <br /> authorization may be in the form of email or any other written communication. Lessee agrees <br /> that during its use of the Premises and occupancy thereof, Lessee shall comply with the laws, <br /> rules and regulations of the governments of the United States, State of Washington, Snohomish <br /> County, and City of Everett. Lessee agrees to maintain the Premises in good condition and <br /> repair throughout the term of the lease. Upon termination of the lease, Lessee shall quit and <br /> surrender the Premises in as good a state and condition as reasonable use and wear and tear <br /> thereof permit. Except for any damage caused by Lessee or its employees, agents, customers or <br /> invitees, which shall be restored by Lessee to as good a state and condition as existed before such <br /> damage occurred.
