In 1987 the beauty shop was changed to the <br /> present use, which is the "Children's Attic" a <br /> secord hand children's clothing store, where <br /> children's clothing is sold on consignment. <br /> When the Applicant applied for a business <br /> license the City became aware that the parking <br /> requirement was not being met. <br /> The parking requirement for this use is for a <br /> total of eight spaces, three for the residen- <br /> tial use and five for the retail use. <br /> It has been City policy to allow credit for a <br /> previous nonconformity in calculating the <br /> parking requirement when a use changes, so be- <br /> cause of the previous use's nonconformity of <br /> three spaces, the total parking requirement <br /> for the Children's Attic and two apartment <br /> units would be five spaces. <br /> The Applicant is proposing to construct two <br /> additional off-street parking spaces south of <br /> the building which will then have a total of <br /> four off-street parking spaces which is one <br /> less than required. Because of the small size <br /> of the lot (3,000 square feet) in relationship <br /> to the size of the building (3,120 square <br /> feet), there is no space on the site to pro- <br /> vide additional parking. <br /> Most of the customers of the Children's Attic <br /> live in the neighborhood and so most of the <br /> traffic is "walk in" by residents of the area. <br /> callajlaigaL There are unusual and extraordinary circus- <br /> stances applying to the property and to the <br /> proposed use of the property because of the <br /> fact that it is a nonconforming use and build- <br /> ing in existence since the early 1900's and <br /> because the intensity of use is less than the <br /> usual retail use. <br /> CREMBiow b. 2 POVARTLrnE. <br /> That such variance is necessary for the preservation and enjoy- <br /> ment of a substantial property right of the appellant possessed <br /> by the owners of other properties in the same vicinity or zone. <br /> There are other nonconforming uses in the vi- <br /> cinity and zone that do not provide parking to <br /> code. <br /> asIow: Granting this variance is necessary in order <br /> for the Applicant to enjoy a substantial prop- <br /> erty right enjoyed by others in this vicinity <br /> and zone. <br /> Ceawmtres MD. 3 Pts!
