The use of the structure for human occupancy is a violation of IPMC code section 108.1.3 <br /> The use of flexible cords for permanent wiring is prohibited by IPMC section 605.4 <br /> The detached structures referred to in your inquiry are unlawful structures as defined by IPMC code section 108.1.4 <br /> Thank you for the opportunity to provide assistance in this matter. <br /> Ted Budden <br /> Chief Inspector <br /> Everett Building Department <br /> 425.257 7271 <br /> From: Cynthia Keirsey <br /> Sent: Tuesday, September 29, 2015 10:38 AM <br /> To: Felicia Medlen <br /> Cc: Ted Budden <br /> Subject: Uses and structures at 3315 Pine Street. planning review requested for Code Enforcement <br /> Felicia, <br /> I responded to the property at 3315 Pine Street for a report of an occupied shed and tarp structures .The inspection and <br /> search of records revealed a residence that is located in a C-2 Heavy Commercial, Light Industrial zone.The elderly <br /> couple who live in the house have allowed their adult son to build and occupy a garage structure that was constructed <br /> up to the property line without permits.The son Donald Duncan is conducting a salvage business with an open UBI <br /> number"Almost New Salvage" UBI#603464869 without a city business license.A good portion of the business is being <br /> conducted on an adjacent vacant lot with a different property owner.The property owners are also re-constructing a <br /> small storage shed in the front of the house that is almost entirely within the right of way without a PW permit. The <br /> previous small shed was completely removed except for a concrete slab under it.The detached garage that is being <br /> occupied and used for the salvage business has hazardous electrical including extension cords that power cooking <br /> appliances and a refrigerator. I will likely condemn the garage built without permits, order it vacated and require that a <br /> permit be obtained or it be demolished. <br /> Questions for planning: <br /> 1. Is the salvage business allowed in the C-2 zone? If allowed does the outdoor storage of salvage materials need to <br /> be screened or meet other performance standards for such uses in this zone? <br /> 2. Do the property owners need a PW permit for the re-building of the small shed in the right of way?Can this <br /> small shed in the right of way be certified as legal non-conforming? <br />
