,(P/oer,mimal <br /> ORDINANCE NO. 3 6 7 0-19 <br /> AN ORDINANCE providing for the Vacation of a portion of State <br /> Street, a portion of l7"' Street, and the alleyways within Blocks 324 <br /> and 325,Plat of Riverdale Addition. <br /> WHEREAS, David Beekan, owner of 3212 16th Street, Dong Ping Zheng, owner of 3218 16th <br /> Street, and David Ratliff, managing member of Riverview LLC, owner of 1602, 1616, 1626, & <br /> 1628 E. Marine View Drive (collectively, the"Petitioners") did petition for the vacation of <br /> certain rights of way in the City; and <br /> WHEREAS,the City Council did, by Resolution No. 7335, establish March 6, 2019, at 6:30 <br /> P.M. as the date of the public hearing; and <br /> WHEREAS,after holding the public hearing and receiving public comments,the City Council <br /> determined that the public interest would best be served by granting the petition and vacating the <br /> rights of way,but retaining an easement over a portion of the vacated rights of way for utility <br /> purposes, as provided for in this Ordinance; <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Vacation. <br /> Subject to the reservation of the easement described in Section 4, the following described rights <br /> of way; <br /> ALL THOSE PORTIONS OF: <br /> THE NORTH—SOUTH ALLEY WITHIN BLOCK 324,RIVERDALE ADDITION,ACCORDING TO THE <br /> PLAT THEREOF RECORDED IN VOLUME 10 OF PLATS,PAGE 45,IN SNOHOMISH COUNTY, <br /> WASHINGTON. <br /> THE EAST—WEST ALLEY WITHIN BLOCK 324,RIVERDALE ADDITION,LYING BETWEEN THE <br /> WESTERLY RIGHT-OF-WAY LINE OF GRAND AVENUE AND THE SOUTHERLY PROJECTED <br /> EAST LINE OF LOT 9 OF SAID BLOCK 324. <br /> 17TH STREET BETWEEN THE LIMITS OF THE WESTERLY RIGHT-OF-WAY LINE OF GRAND <br /> AVENUE AND THE SOUTHERLY PROJECTED EAST LINE OF LOT 20,BLOCK 324,RIVERDALE <br /> ADDITION. <br /> Page 1 of 4 <br />
