40:/4 a//::AMI <br /> J <br /> RESOLUTION NO. 6670 <br /> A RESOLUTION authorizing recovery of abatement costs <br /> pursuant to EMC 1.20.090 at 1101 E Marine View Drive, Everett, Washington. <br /> WHEREAS,the Everett Municipal Code (the "EMC") Section 1.20.090 authorizes the <br /> City to abate code violations and recover the abatement costs; and <br /> WHEREAS,on July 26, 2012,the City of Everett Violations Hearing Examiner issued an <br /> Order against the property owners (the "Respondents") for EMC violations at 1101 E Marine <br /> View Drive (the "Property"),parcel number 00438322800100, and abbreviated legal description: <br /> EVERETT DIV 0 PLAT OF BLK 228 D-00—LOT 1 <br /> WHEREAS the Respondents failed to abate the violations, including removing the <br /> unlawful deck and garage on the property, discarded junk,trash, and vehicle parts in the yard and <br /> visible to the-public-or neighbors, and inoperable vehicles on the Property by the date set by the <br /> Order. <br /> WHEREAS, Snohomish County Superior Court entered a warrant of abatement allowing <br /> the City enter the Property and conduct the abatement of the above-described violations at the <br /> sole cost of the Property owners, and that those costs together with any penalties imposed by the <br /> Hearing Examiner may become a lien against his property if the Property owners failed to <br /> reimburse the City the abatement costs. <br /> WHEREAS,the City,through a contractor, conducted the abatement on July 30, 2013. <br /> WHEREAS,the City incurred costs in the amount of$5,370.96 in its abatement of the <br /> violations and attorney's fees and other costs in the amount of$488.00 and the Hearing <br /> Examiner imposed a penalty of$2,500.00 against the Respondent; and <br /> WHEREAS,notice of Council's consideration of this Resolution was provided to the <br /> property owner; <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Everett that the <br /> costs apd-penalties-set forth in the report-attached-hereto is confirmed for the Property. The City <br /> Treasurer is authorized to certify the amount due and owing to the County Treasurer, which <br /> amount shall then be entered as an assessment upon the tax rolls against the Property with <br /> interest as provided by law. <br /> 1 <br />
