<br /> Based upon a review of the above record, the following Findings of Fact and
<br /> Conclusions of Law hereby constitute the basis of the decision of the City of Everett
<br /> Violations Hearing Examiner.
<br /> FINDINGS OF FACT
<br /> 1. Karen D. Loth and Andrew G. Armitage, Respondents, are the owners of record of
<br /> property at 1101 E. Marine View Drive, Everett, Washington (property). Richard
<br /> Irby, who is deceased,was a tenant who was living in the cellar of the property.
<br /> The property is in an R-2 Single-Family Detached Medium Density zone in the City
<br /> of Everett. (Exhibit#10, Snohomish County Assessors Record dated July 20, 2012)

<br /> 2. On February 15, 2012, City of Everett Code Enforcement Officer Tamara Gregory
<br /> conducted an inspection of the property and observed and photographed
<br /> appliances in the front yard, a broken screen door, lumber, junk, trash, litter, vehicle
<br /> parts and other similar debris discarded in the side yard, and vehicle parts,junk
<br /> vehicles, lumber, and other debris discarded in the rear yard. These items could be
<br /> viewed from the 12th Avenue. During the February 15, 2012 inspection, Code
<br /> Officer Gregory confirmed that Richard Irby was living in the cellar. A search of the
<br /> City of Everett permit records revealed that no permits had been issued for the
<br /> conversion of the cellar to habitable space. Ms Gregory is no longer employed at
<br /> the City of Everett Code Enforcement unit but Kevin Fagerstrom was her immediate

<br /> 3. On July 1, 2010, twenty months prior to the hearing date on the instant violation, an
<br /> Order was issued by the Everett Hearing Examiner against the Respondent, Andy
<br /> Armitage, and Richard Irby,for nuisance violations on the property. The Order
<br /> required the Respondents to remove and properly dispose of the discarded items
<br /> from the property and a fine in the amount of$1,000.00 to be suspended if the
<br /> violations were abated prior to July 7, 2010. (Exhibit#8, Final Findings of Fact,

<br /> 4. On February 21, 2012, the City issued the Respondents a violation citation. The
<br /> Respondents were notified via certified mail return receipt and first class mail,
<br /> personal service and posting, that conditions on the property violated Everett
<br /> Municipal Code (EMC) §8.20.020 (A), (C), (G), 8.22.030, International Residential
