By way of <br /> example and not limitation, no development permit may be issued; no subdivision of land may be <br /> approved; no clearing,filling, or grading may occur; nor may any use be established, altered, or <br /> expanded on any lot until approvals required by this chapter have been granted by the city. <br /> B. In addition to the requirements of this chapter,the applicant shall obtain all necessary stater-,and <br /> federal and other local permits. <br /> Section 3. Section 4 of Ordinance 2909-06, as amended, (Zoning Code, Critical Areas, EMC 19.37.040), <br /> is hereby amended as follows: <br /> 19.37.040 Critical area features. <br /> On all lots containing or within 300 feet ofadjoining critical areas,the following features and their <br /> buffers shall not be altered or developed except as otherwise permitted by this chapter: <br /> A. Areas of special flood hazard (if located in a designated floodplain, also see Chapter 19.30 of the <br /> Everett Municipal Code); <br /> B. Wetlands; <br /> C. The following geologically hazardous areas: <br /> 1. Erosion hazard areas; <br /> 2. Landslide hazard areas; <br /> 3. Seismic(liquefaction) hazard areas; <br /> D. Fish and wildlife habitat conservation areas, including streams/riparian areas, lakes less <br /> than twenty acres in size, marine waters, habitats of primary association, continuous vegetative <br /> corridors linking watersheds, and significant biological areas as defined in this title;listed in Section <br /> 37.110.A.5; <br /> E. Ground water discharge areas, such as springs and seeps,that are as✓ociated with or occur upon <br /> any of the critical areas listed in subsections A through D of this section. <br /> Section 4. Section 5 of Ordinance 2909-06, as amended, (Zoning Code, Critical Areas, EMC 19.37.050), <br /> is hereby amended as follows: <br /> 19.37.050 Exemptions—Exceptions—Modifications. <br /> Certain activities are exempt from the requirements of this chapter, while other activities which are <br /> regulated by this chapter may be granted specific exceptions or an administrative modification:as <br /> provided in this chapter.This section lists the activities which are exempt from the regulations of this <br /> chapter,the exceptions which may be granted to the requirements of this chapter, and the <br /> administrative modifications which can be granted to the requirements of this chapter other <br /> requirements of this title of the city code. <br /> All activities or developments which are exempted, excepted, or granted modifications shall use <br /> reasonable methods to avoid and minimize potential impacts to critical areas, including use of any <br /> applicable best management practices. Such activities or developments which are exempted, excepted, <br /> or granted modifications shall not be exempt from other laws or permit requirements which may be <br /> applicable. <br /> A. Exemptions.The following are exemptions to the provisions of this chapter; however, the <br /> exemptions listed in this section may not be exempted from other state or federal regulations or <br /> permit requirements.Any incidental damage to, or alteration of, a critical area that is not a <br /> EMC Title 19.37 (Critical Areas) Page 4 <br />
