"Wetlands, regulated" means those areas that are inundated or saturated by surface or ground water at <br /> prevalence of vegetation adapted for life in saturated soil conditions. Regulated wetlands generally <br /> include swamps, marshes, ponds, bogs and similar ar as. Regulated wetlands do not include those <br /> and drainage ditches,grass lined swales,canals,detention facilities, wastewater treatment facilities, <br /> farm ponds, and landscape amenities, or those wetlands cr ated after July 1, 1990,that were <br /> unintentionally created as a result of the construction of a road, street,or highway. Wetlands created as <br /> mitigation and wetlands modified for approved land use activities shall be considered as regulated <br /> wetlands. For identifying and dclin ating regulated wetlands, the city shall use the Washington State <br /> Wetland Identification and Delineation Manual. <br /> "Wetlands, riparian" means those wetlands that generally occur within a riparian corridor that is <br /> that arc not hydrologically affected by water in a nearby str am are not riparian wetlands. However, <br /> wetlands on a hillside may be riparian wetlands if adjacent to a stream that flows down the hillside. <br /> "Wetlands, scrub shrub" means a regulated wetland that does not qualify as a forested wetland with at <br /> least thirty percent of its surface arca covered by woody vegetation less than twenty feet in height as <br /> the uppermost strata. <br /> Section 36. Section 4 of Ordinance 1671-89, as amended (Zoning, Zoning code definitions,floodplain <br /> overlay zone definitions, EMC 19.04.030), is amended as follows: <br /> 19.04.030 Floodplain overlay zone definitions. <br /> Following are the floodplain overlay zone definitions pertaining to Chapter 19.30 of this title, as <br /> amended, and unless expressly provided otherwise,to all other provisions of this title that are governed <br /> by Chapter 19.30. <br /> "Shoreline permit" means a permit issued by the city for development adjacent to water bodies per <br /> Chapter 90.58 RCW and Chapter 173-14 WAC and the Shoreline Master Program.The floodplain areas <br /> arc included in the jurisdiction of the shoreline permit. However, not all development needs a shoreline <br /> permit. See the definition of"floodplain development permit." <br /> Section 37. Section 4 of Ordinance 1671-89, as amended (Zoning, Zoning code definitions, EMC 19.04) <br /> is amended to add the following new section, to be codified as EMC 19.04.040: <br /> 19.04.040 Critical areas definitions. <br /> This section defines specific terms to be applied where used in Chapter 19.37 of this title. <br /> "Alteration" means any human-induced action which impacts the existing condition of a critical area. <br /> Alterations include but are not limited to grading; filling; dredging; draining; channelizing; cutting, <br /> pruning, limbing or topping, clearing, relocating or removing vegetation; applying herbicides or <br /> pesticides or any hazardous or toxic substance; discharging pollutants; grazing domestic animals; paving, <br /> EMC Title 19.37 (Critical Areas) Page 71 <br />
