Section 41 of Ordinance 1671-89, as amended (Zoning,Administration, EMC 19.41.), is <br /> amended as follows: <br /> 19.41.130 Variances. <br /> D. Variances Prohibited. Under no circumstances shall the review authority grant a variance to any <br /> of the following: <br /> 1. To any provisions establishing the uses or buildings that are permitted to locate or that may <br /> continue to operate in any zone; or <br /> 2. To any of the procedural provisions of the code; or <br /> 3. To any provision that specifically states that its requirements are not subject to variance; or <br /> 4. To minimum lot size or maximum residential density requirements. <br /> 5. To the critical areas standards in Chapter 19.37 of this title. <br /> Section 41. Chapter 4,Section 2 of Ordinance 2530-01, as amended (Local Project Review Procedures, <br /> Procedures for Types of Land Use Decisions, EMC 15.16.050), is amended as follows: <br /> 15.16.050 Decisions included. <br /> A. Review Process I applications include the following minor administrative decisions: <br /> 4. Buffer width averaging and buffer width reduction for wetlands, lakes and streams(Section <br /> 19.37.185b streams(Sections 19.33D.490(D)and 19.37.170(C))or wetlands(Sections <br /> 19.33D.450(E)and 19.37.110(C))or alteration of geologically hazardous areas or standard buffer <br /> (Section 19.37.080(C)) if proposal is categorically exempt under SEPA; <br /> 8. Development of previously altered critical areasESAs when the proposal is categorically exempt <br /> under SEPA(Section 19.37.250 19.33D.580 or 19.37.250); <br /> 21. Reasonable use determinations, if no modification of zoning standards (under Section <br /> 19.33D.100(B)or 19.37.050(433); <br /> 22. Relocation of electric facilities, lines, equipment or appurtenances, natural gas, cable <br /> communications, pipes, mains, equipment or appurtenances,telephone facilities, lines related to <br /> fflentall,i sensitivecritical areas as provided by Section 19.33D.100(A)(9)(b)and (c)or <br /> 19.37.050(A){84194-an444 <br /> 40.
