I. Providing for the maintenance and enhancement of views, solar access, and/or elimination of future <br /> potential hazards or nuisances while protecting critical area functions and values. <br /> 19.37.030 Applicability. <br /> A. This chapter establishes regulations for the protection of critical areas that arc not otherwise <br /> provisions of this chapter and appliesy to all lands, all land uses and development activity, and all <br /> structures or facilities outside of shoreline jurisdiction in the city,whether or not a permit or <br /> authorization is required, and shall apply to every person,firm, partnership, corporation,group, <br /> government agency,or other entity that owns, leases or administers land within the city. No person, <br /> company, agency,or applicant shall alter a critical area or buffer except as consistent with the purposes <br /> and requirements of this chapter. For development proposals on properties within shoreline jurisdiction, <br /> the Shoreline Master Program applies in addition to the regulations contained in this chapter. Except <br /> . . _ .. - •- - - - -- - - 4:•••• • ••• <br /> shoreline jurisdiction in the marshland subarea. No development permit may be issued; no subdivision <br /> of land may be approved; no clearing,filling, or grading may occur; nor may any use be established, <br /> altered,or expanded on any lot until approvals required by this chapter have been granted by the city. <br /> B. In addition to the requirements of this chapter,the applicant shall obtain all necessary statet-and <br /> federal and other local permits. <br /> 19.37.040 Critical area features. <br /> On all lots containing or within 300 feet ofadjoining critical areas,the following features and their <br /> buffers shall not be altered or developed except as otherwise permitted by this chapter: <br /> A. Areas of special flood hazard (if located in a designated floodplain, also see Chapter 19.30 of the <br /> Everett Municipal Code); <br /> B. Wetlands; <br /> C. The following geologically hazardous areas: <br /> 1. Erosion hazard areas; <br /> 2. Landslide hazard areas; <br /> 3. Seismic(liquefaction) hazard areas; <br /> D. Fish and wildlife habitat conservation areas, including streams/riparian areas, lakes and ponds less <br /> than twenty acres in size, marine waters, habitats of primary association, continuous vegetative <br /> corridors linking watersheds, and significant biological areas as defined in this title;listed in Section <br /> 37.110.A.5; <br /> E. Groundwater discharge areas; seeps and springs. <br /> 19.37.050 Exemptions—Exceptions—Modifications. <br /> Certain activities are exempt from the requirements of this chapter, while other activities which are <br /> regulated by this chapter may be granted specific exceptions or an administrative modification.-a-s <br /> provided in this chapter.This section lists the activities which are exempt from the regulations of this <br /> chapter, the exceptions which may be granted to the requirements of this chapter, and the <br /> administrative modifications which can be granted to other requirements of this title of the city code. <br /> All activities or developments which are exempted, excepted, or granted modifications shall use <br /> reasonable methods to avoid and minimize potential impacts to critical areas, including use of any <br /> applicable best management practices.
