B. Exceptions. The following are exceptions to the requirements of this chapter; however, the <br /> exceptions listed in this section still require compliance with the other requirements of this chapter. <br /> The exception may not be exempted from other state or federal regulations or permit requirements. <br /> Any incidental damage to,or alteration of, a critical area that is not a necessary outcome of the allowed <br /> development shall be restored, rehabilitated, or replaced at the expense of the property owner. <br /> 1. Where structures, lawns and associated improvements have been legally established within a buffer <br /> area, new structures and additions to existing structures up to 200 square feet may be permitted <br /> within the improved portion of the buffer as follows: <br /> a. The 200 square foot limit shall include all associated improvements such as walkways or other <br /> impervious areas. <br /> b.The new structure or addition shall be placed within the outer 50 percent of a legally altered <br /> critical area; <br /> c.The new structure or addition maintains a minimum setback of ten feet from the critical area; <br /> d. A minimum of one square foot of legally altered buffer area is restored for every one square foot <br /> of new structure; <br /> e. A critical area covenant is recorded; <br /> f.A habitat assessment is completed if within a F stream buffer; <br /> g.A fence and critical area sign is provided to protect the newly established buffer area; and <br /> h.Only one exception may be granted per site or property. <br /> 27. Wetland-Size Exceptionxemptions.The following wetlands are exempt from compliance with the <br /> wetland preservation and protection goalsmiti_ation sequencing provisions in this chapterSectien <br /> 37.120.A. Mitigation must be provided for any approved impacts per Section 37.110 of this chapter.: <br /> a. Category III and IV wetlands less than one thousand square feet in ar a that meet all of the <br /> following criteria: <br /> i. The wetland is not associated with a riparian corridor; <br /> ii. The wetland is not part of a wetland mosaic; and <br /> iii. The wetland does not contain habitat identified as essential for local populations of priority <br /> species identified by the Washington State Department of Fish and Wildlife. <br /> b. Category III and IV wetlands between one thousand square feet and four thousand square feet <br /> in area that meet all of the following criteria: <br /> i. The wetland is not associated with a riparian corridor; <br /> ii. The wetland is not part of a wetland mosaic; <br /> iii. The wetland does not contain habitat identified as essential for local populations of priority <br /> species identified by the Washington State Department of Fish and Wildlife; and <br /> iv. The wetland scores three or four points for habitat in the 2014 Western Washington Wetland <br /> Rating System. <br /> a. All isolated Category IV wetlands less than 4,000 square feet that: <br /> i. Are not associated with riparian areas or their buffers <br /> ii.Are not associated with shorelines of the state or their associated buffers <br /> iii.Are not part of a wetland mosaic <br /> iv.
