Everett Police Department <br /> 1 Code Enforcement Unit <br /> 8/23/2017 C E 17-0477 <br /> Joyce E Lozano <br /> 9025 Evergreen Way <br /> Everett, WA 98204 <br /> Violation Address: 8519 8TH AVE W EVERETT WA 98204-1612 <br /> Dear Property Owner, <br /> Our office received a complaint indicating the swimming pool at your property did not <br /> have a code compliant enclosure/gate. An inspection of your premises/property located <br /> at 8519 8TH AVE W, was made on June 19, 2017. The inspection revealed the pool is <br /> covered with flexible material and not currently in use. Despite the current lack of use, <br /> the pool exceeds a depth of 24 inches and is not enclosed as required by code. The <br /> current conditions are a violation of the following sections of the Everett Municipal <br /> Code (EMC) and/or the International Property Maintenance Code (IPMC) as adopted <br /> by the EMC, which read: <br /> The lack of a code compliant enclosure for swimming pools with a depth greater than <br /> 24 inches, and the poor condition of the swimming pool, are violations of IPMC 303.1 <br /> and 3032, which read: <br /> IPMC 303,1 Swimming Pools, <br /> Swimming pools shall be maintained in a dean and sanitary condition, and in good <br /> repair. <br /> IPMC 303.2 Enclosures, <br /> Private swimming poo/s, hot tubs and spas, containing water more than 24 inches <br /> (610 mm)in depth shall be completely surrounded by a fence or barrier not less <br /> than 48 inches(1219 mm)in height above the finished ground level measured on <br /> the side of the barrier away from the pool. Gates and doors in such barriers shall be <br /> self-dosing and self-latching. Where the self-latching device is not less than 54 <br /> inches(1372 mm)above the bottom of the gate, the release mechanism shall be <br /> located on the pool side of the gate. Self-closing and self-latching gates shall be <br /> maintained such that the gate will positively dose and latch when released from an <br /> open position of 6 inches(152 mm)from the gatepost. No existing pool enclosure <br /> shall be removed, replaced or changed in a manner that reduces its effectiveness as <br /> a safety barrier. <br /> Exception:Spas or hot tubs with a safety cover that complies with STM F 1346 <br /> shall be exempt from the provisions of this section. <br /> 61/ (--1 <br /> Everett Police Department,Code Enforcement Unit•3002 Wetmore Ave•Everett,WA 98201 •425-257-8560 <br />
