Exhibit 9 Go Sync Map <br /> Exhibit 10 Exhibit List,dated December 6, 2018 <br /> Based upon a review of record, the following findings of fact and conclusions of law hereby <br /> constitute the basis of the decision of the Everett Violations Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. The Estate of Frank Harley Rowe(Respondent) is the owner of property at 1832 Chestnut <br /> Street,Everett, Washington(subject property), which is in an R-2, Single-Family Medium <br /> Density Residential zone. Frank Harley Rowe died on March 30,2018. John White and <br /> Denise Allinder-Herz(Respondents) are the tenants of the residential structure located on <br /> the subject property. (Exhibit#8, Snohomish County Assessor's record, dated November 19, <br /> 2018) (Exhibit#9, Go Sync Map) <br /> 2. On October 4,2018,the City of Everett Utility Department informed Officer Golden that <br /> water service to the occupied residential structure had been disconnected on October 1, 2018 <br /> for non-payment. The absence of an approved water service renders a residential structure <br /> unfit for human habitation. (Exhibit#5, Email from Gray Braaten, dated October 4, 2018) <br /> (Testimony of Code Enforcement Officer Golden) <br /> 3. In response to a complaint of an occupied motor home parked on the subject property, City <br /> of Everett Code Enforcement Officer Edward Golden conducted an inspection of the subject <br /> property on October 5,2018. While on site, Officer Golden observed and photographed that <br /> uncontained bagged garbage,junk,debris,household equipment, and articles of personal <br /> property had been discarded in public view in the rear yard and that the vegetation in the <br /> rear and side yards exceeded the allowed maximum height of 12-inches. These conditions <br /> constitute a violation of the Everett Municipal Code and are an annoyance that disrupts and <br /> injures the comfort,repose,health, and safety of others. There was no occupied motor home <br /> observed parked on the subject property. (Exhibit#1 c-Ij, Inspection Photos, dated October <br /> 5, 2018) (Testimony of Code Enforcement Officer Golden) <br /> 4. On October 8,2018,the City issued a violation citation to the Respondents for violations of: <br /> International Property Maintenance Code(IPMC) 106.1 Unlawful Acts as adopted by EMC <br /> 16.005.010; IPMC 108.1.3 Structure Unfit for Human Occupancy as adopted by EMC <br /> 16.005.010; IPMC 308.1 Accumulation of Rubbish and Garbage as adopted by EMC <br /> 16.005.010; IPMC 505.1 Water System General as adopted by EMC 16.005.010; IPMC <br /> 505.3 Water Supply as adopted by EMC 16.005.010; and Everett Municipal Code (EMC) <br /> 8.20.020 (A) (C) (E)and (G)Nuisances—Residential Property and Nonresidential Property;. <br /> Copies of the violation citation were sent via first class and certified mail to the <br /> Respondents' last known address,which Officer Golden obtained from Snohomish County <br /> Assessor's record. A copy of the violation citation was posted on the subject property. <br /> Each method of service used is independently sufficient to provide notice pursuant to EMC <br /> 1.20.010.C.1.
